About IARP:
The Independent Accountability Resolution Process is comprised of independent investigators, advocates and adjudicators who are responsible for reviewing select infractions cases in Division I. The IARP was created in response to recommendations issued by the Commission on College Basketball. For more information about the IARP please visit http://www.iarpcc.org.

Ouch, wonder which one we are:
Quote:Complex cases may include alleged violations of core Association values, such as failing to prioritize academics or the well-being of student-athletes; the possibility of significant penalties; or conduct that is contrary to the cooperative principles of the existing infractions process. Multiple parties can request referral of an infractions case: school representatives, the Division I Committee on Infractions chair or the vice president of the enforcement staff.
I'd say "conduct that is contrary to the cooperative principles of the existing infractions process" applies.
Yep, it wouldn't surprise me if they're going to try to pin the court order on UofM or say that the UofM pressured Wiseman to do it, or something.

RE: Memphis’ infractions case will be resolved through the IARP
So, do we know if the NCAA made the request, or did the UofM?
A request for referral of the infractions case involving the University of Memphis to the Independent Accountability Resolution Process was granted by the Infractions Referral Committee.

Unless the available information is false.
If Penny disclosed the payment there is nothing additional that really can be done.
We knowingly played an ineligible player. They are going to hammer us for that.
I seriously doubt that.
An injunction was in place by the courts which the school had to follow (Case filed by player). We have a precedent here.
Jerry Tarkanian coached for several years with an injunction stopping the NCAA from suspending him. You know what happened when he lost that case...Nothing. Hell he wasn't even suspended afterwards.
The injunction just stated that Wiseman couldn't be suspended. It did not said that he had to be played in a game.

I don’t remember playing him once the NCAA announced that he was ineligible. However, we did continue to play him after they went from eligible to “likely ineligible”. As you said, he is either eligible or ineligible and “likely ineligible” does not change eligible into ineligible.
Seems simple enough.

Try to sell sitting the #1 player in the country to a judge as not being a suspension.

RE: Memphis’ infractions case will be resolved through the IARP
The NCAA handed down the penalty after the injunction was withdrawn: Wiseman sits for 12 games, and pays back the $11,500 with his own money (no gofundme, university funds or donor contributions).
Wiseman sat out a portion of those games, but withdrew from school before he served the full 12-game penalty. However, he did not play for Memphis after the injunction case was withdrawn, so one could argue that served the 12-game suspension since he hasn't played for the Tigers since November.
I have not idea whether or not Wiseman paid the $11,500 back yet. He hadn't as of his interview a few weeks ago. However, since he's now a professional, I expect he can afford it, if he is so inclined to repay it.
If Wiseman repays the $11,500, wouldn't that be the end of it?

RE: Memphis’ infractions case will be resolved through the IARP
Am I the only one who thinks this may turn out to be better than the NCAA Committee on Infractions making the decision? If this is an independent 3rd party board, does it take away the temptation that the NCAA might have to "make an example" out of Memphis because we didn't lie down and do what they wanted us to do?
There are still things about this case that I don't understand and I hope this process sorts through all the details of the case.
For example, I still don't know what "likely ineligible" means. It seems the NCAA shot themselves in the foot with that wording alone. We are supposed to sit a player because he is likely ineligible?! A player is either ruled eligible or ineligible. Is there any precedent for the NCAA finding a player "likely ineligible"?
And can someone explain why this investigation was opened again right as the season was getting started when the NCAA had already cleared Wiseman!?
It will certainly be interesting to see how it all plays out.

really never understood how a minor could be financially responsible for
a parent/guardians action
the legal minds are going to have to sort that out

RE: Memphis’ infractions case will be resolved through the IARP
I think Wiseman could and probably should file suit against the NCAA the day after the championship game.
He was denied a chance to play a season of basketball after being led to believe he was cleared by the NCAA. He has a pretty clear case if indeed the payments were known at the time of his initial clearance. He does not need the university to support his case one way or another. The university would simply be a fact witness in the case.
I hope he takes that big NBA salary and sues the NCAA for enough to make his NBA money look like peanuts.
