Cool cool. An Actual Constitutional Attorney. Amazing.

Four Actual Constitutional Attorneys have weighed in, and found the issue wanting. Imagine that.

Maybe read the actual SCOTUS cases yourself. Its pretty clear.

Or not.

"This clown was found to be an MS-13 gang member"

Did you read the filings, champ? There was a determination without any due process. No notice, no opportunity to present anything by the dude himself. Big diff than 'found'. Seriously, read the filings.

Do you really think that some shitbird sitting in a backroom saying you are a gang member without giving any notice, and any opportunity for the person to present anything to the contrary is somehow 'found to be an MS-13 member'?

What looney tunes box of fruit punch are you drinking from, champ?

Look, if he is accorded that due process, given notice, and has the opportunity to defend, and an impartial trier of fact finds he is gang member -- ship him off under any number of relevant immigration provisions. That didnt happen here. You seem to act as though it did somehow.... coool cool. Or seem to not give a **** that due process wasnt afforded. Which is really stupid as **** when you actually decide to think about it. But.... decding to think about it, let alone thinking about it, might be an awfully tall order for some around here, I surmise....

Read it all retard.... he was accorded due process multiple times and was found to be a gang member 6 years ago. And like I said, he shopped around until a leftist judge let him just.... you know hang out here indefinitely.

Just like leftist DAs all over this country in leftist shithole cities letting criminals, you know.... Just hang out, killing, raping, and pillaging the shithole blue cities.

Cool cool. You certainly are the apex of classical liberalism that you incessantly bleat and say you are. Havent heard of the 'just shoot them' branch though. Sounds neato.

First, I suggest sending a link to a full cite. Not a fing one sentence blurb on X.

And lets go through the steps (and Ill send you a full cite to the history instead of your ****** ass link to an X post.

First ---

In the first proceeding, two things of note. The govt accuses Obrego of being an 'active' MS-13 member (a danger to the community), which ostensibly failed. Since a danger to the community would not be a candidate for asylum. Period.

His attorneys claimed, and ICE later confirmed, that the only verification came from a form filled out by the Prince George County Police Department, which based his membership on the fact that "he was wearing a Chicago Bulls hat and a hoodie; and that a confidential informant advised that he was an active member of MS-13 with the Westerns clique" – a group based out of Long Island, New York.

Based on that the immigration judge found him to be associated with MS-13, and then proceeded to allow him status to seek asylum.

The due process afforded to him allowed him to be exempted from immediate deportation as an active member, and further allowed him protected status.

That second clause is highly important, Maxi. The courts allowed him exemption. An expemption that, to be overturned, had to be done with further (drum roll..... ) due process.

Cut to three weeks ago. No due process as to removing the exemption. None. Zero. Zilch. Nada. The executive branch simply fing ignored the results of the due process afforded him earlier. And did so without *any* due process in the later timeframe.

And the stupid fks think that the earlier due process counts. It should. You dont seem to fing realize that the due process afforded him *then* RESULTED in an exemption. Are you that fing dense?

If the Executive Branch wishes to throw Obrego to the El Salvadorans, they should *absolutely* take the requisite steps of due process to overturn the previous findings. Something that doesnt seem to fing click in that skull of yours while you scream 'he was afforded due process'. You dont seem to recognize that that rouond of processs EXEMPTED his removal. Good grief.

Quote:Just like leftist DAs all over this country in leftist shithole cities letting criminals, you know.... Just hang out, killing, raping, and pillaging the shithole blue cities.

The poor gang bangers.... they didn't do nuffin wrong. Get bent.

What part of 'if they can show that with due process, I dont have a problem with deportations of gangbangers' do you NOT understand? That is, of course, the small step of actually showing it I guess....

Nice polemic, rhetorical rant you have above. Unfortunately, it doesnt really apply to anything in the case or cases.

Finally, the issue is removal under the Enemy Aliens Act. If you were bright enough to read the transcript from this case, or the one under Boasberg, you might notice that the judges there have zero problem with removal under other sections, and when removal under other sections has been deemed proper with appropriate due process. Boasberg specifically said the folks in the planes not being deported under the Enemy Aliens were not in question.

What was in question were the number that were being deported under the EA act, and whether those that were being deported under the EA act were being deported properly and with sufficient Due Process.

The issue in Obrego is similar. You squawk he 'was under a deportation order.' That is somewhat of a deceptive statement. There was an ongoing deportation order, but that order was stayed pending a proper asylum determination. You miss that 'on hold' aspect completely -- imagine that.

And that situation does not give a freebie to the Feds to swoop in and send out -- especially considering the asylum hold. No, for purposes of deportation under EA act, there was absolutely no due process afforded Obrego.

Notwithstanding your clownish jumping up and down and throwing phrases around.

If the Feds want to deport him, afford him due process to that effect. Dont violate the previous due process that allowed his exemption to seek asylum without due process in the second round.

I am impressed by your not on point spittle flecked rager against DAs and 'they didnt do nothing wrong'. Even if/when they do something wrong, they should be given that iota of due process to do so. Nice rager on dumping the protections of due process. Pretty awesome point of view there.

Nope. Would hope that the authorities would be abe to make a showing with any due process of them being a gangbanger.

They have completly msiised, overlooked, or deliberately shelved that step.

Knew the pinhead brigade would love that lapse, and try to turn the step of requiring a due process step as supporting gangbangers. That is the retarded style argument yall are so good at.

Love the cry over impeach the judge. The judge has every right to determine if the Alien Enemy Act may be used at all --- funny that. And additionally, further aspects of due process must be applied when there is no declaration of war.

Yeah, impeach the judge for knowing the caselaw history, and the text of the Act. And applying those to the current case. Lolz.

If the court finds there is an actual, proper, declaration of war (which last time I saw the President cannot do) -- the President actually has full plenary power to ship off people from those countries. Ol Donnie Boy's gang kind of expanded that to idiocy lately.

And the braying fktards actually think the judge cannot even determine if the text of the statute is met, let alone whether any due process safeguards were extended where required.

They ls seem to have missed in their masturbatory celebration the government admission in the filings that the government deported Obrego due to their mistake. Oh well, Im sure lil ol things like the gvernment admitting to the court that the deportation itself was an "error" (actual quote) makes no difference.

Yeee-haw......

You need to go back and review the times the Act has been used and the specific dates covered. This will dispel the war proclamation narrative you are attempting to pedal.

You may also want to note that the President can unilaterally use the act to combat an invasion or predatory incursion. I don’t know why you intentionally leave out facts that I’m sure you know. It’s almost like you are intentionally trying to mislead. Or maybe you’re just a bad lawyer and pontificate on subjects you lack knowledge of, but present yourself as an expert.

I have. And Ive read the SCOTUS cases on point, as well as their district and appellate paths.

In 1947, SCOTUS declined to review removal of Germans. Based solely on the fact that Congress put forth the full scope of the Act when they declared war, and that under a war declaration, the President may act pretty much with impunity.

In that round of cases, the Govt agreed that individuals, even under that expanded fabric during wartime, were to be afforded at least the due process of a court to determine whether the predicate of the act was in place. And further, the govt agreed that due process was needed in some manner to determine if the target was proper (i.e. above 14 years of age, per the statute, and the like).

That is, the government itself agreed that it could not willy nilly pick up, and toss out -- without some intermediate affordation of process.

SCOTUS also made a point that expulsions were proper in 1947 -- solely because Congress hadnt performed the political step of a treaty or other formal legal ending to World War II.

If there were a formal declaration of war, Trump would be free and clear in his moves. Note *formal* declaration -- the exclusive power of Congress. Not some half assed baked statement by the President saying a war exists.

I suggest *you* read the story behind the cases and the cases actually in play. Its kind of a neat read, since a powerful Presidential power can be so amazingly broad when properly invoked. When its half-assed invoked, it looks like a cheap suit thug move (imo).

If you want to move to the invasion or predatory incursion, the notes in the early Congress that passed it make clear that the items above are to be viewed with the term 'by nation states' in the context. The discussions there reveal that the move was obvious when, say, Britain attacks, it is logical to deport British subjects. The last two were included to put the issues of the native american indians into play --- since they werent really 'formal state But they were absolutely viewed as quasi nation-states.

If / when you read the EO by Trump, they are very aware of this necessary component. They write furiously as to the connections between TDA and the Maduro regime. But there is really no evidence that: a) TdA is a nation state of any type; b) that TdA is affiliated with a nation state to such an extent to invoke the nation state status.

https://www.whitehouse.gov/presidential-...de-aragua/

Do you think TdA is a puppet movement of Maduro? If so, I got some swampland I want to sell you....

Look, TdA is nothing I want around. The easier way is to pick them up, show a judge the detainees are illegal and are engaged in criminal activities, and get a plain jane deportation order for tehm under that basis.

Saying that they are a nation state and part and parcel of the country of Venezuela, and stretching the plain issues in the EAA to ludicrous lengths is stupid because it is hogwash. And to me, trying to short circuit basic notions of due process is really disturbing. Which is the path we seem to be on here.

Just do it right, and the right way. Without the histrionics of invoking Presidential War Power which is fing stupid on its face.

If you want more background, PM me and Ill send you citations to the relevant caselaw.

RE: Womp Womp - MS13 member shipped to El Salvador can remain there
If a nation state uses an open border policy as an opportunity to empty its prisons into another country it is certainly an action of that nation to create a predatory incursion. Homicide rates in Venezuela have dropped from 45.6 to 26.2 per 100k over the past 4 years. That’s a pretty strong indicator that they have transported TDA members here in a coordinated manner for their benefit. At the very least, their failure to work to prevent the mass exodus, or properly notify the US of it’s occurrence, makes the nation complicit in the action.

It's like you've never used a smartphone to swipe up or a mouse to scroll.

I posted more in that single link than you did in your entire post.

He came here illegally, he went through the process, deemed a flight risk, found to have been a gang member... and couldn't prove otherwise, then proceeded to use the good ole Biden faithful asylum excuse to remain here as an illegal.

13 years after he walked into our country illegally.

It's no secret why filthy attorneys like all of these illegals and the endless appeals that they cause.
