For fricks sake.

03-no

He keeps conveniently missing that point

All it takes is some ignorant ass peckerhead and one broad and vague law to create some damage. Progressive *or* tighty righty ignorant peckerhead.

You know that. Krist on a cracker both of you have whined at least a few times on that point in the past when a progressive asshat runs amok with some dumb*** interpretation of a poor (vague, overbroad) law.

Now ---- apparently not so much. (slow clap). Absolutely rich. Lolz.

If that pool is too deep for you, I dont know what to say. Aside from 'bless your hearts'.

Youll be famous !!! Awesome. High five for TBE. I can say I knew him in chat before he became world famous for this discovery of his about the concept of 'overbroad and vague'.

Are you going to name it the TigerBlue level of law interpretation? Its stunning that those folks at that number have never heard of that thing that is *not* the 'either / or' that it has been part and parcel of the foundation of our system of law.

And, maybe you will get to teach this in a HS civics class. To replace that concept in all of the other HS civics classes.

I'm not a lawyer nor am I pretending to be, and I am not arguing the finer points of any law.

Until the last few exchanges my only concern about the law is that it prohibits the exploitation of children and it prevents them being exposed to what society by and large considers indecent exposure and lewd and lascivious behavior. You on the other hand, in the interest of protecting a miniscule and deranged segment of society, appear not to care about the safety and welfare of innocent children.

Do you have children?

They could pass a gun ban and collect and crush all firearms, enforced by a house to house search. It would reduce the number of school shootings and protect children. There are people who would endorse that plan because it protects children and prohibits gun violence.

Now I wouldn’t agree with it, but people who support that plan would make the same type of arguments you are making now.

The idea of justifying a non-objective, vague, and broad law is not something I would brag too much about. Saying 'its for the kids' doesnt act as a justification for a law like that, as you point out above.

Fair enough. Ill retract the crticism.

Do you understand the issue of "overbroad and vague" and how there arent degrees of that? If you say yes, then we just move on from that.

Until the last few exchanges my only concern about the law is that it prohibits the exploitation of children and it prevents them being exposed to what society by and large considers indecent exposure and lewd and lascivious behavior.

First, you said 'until the last few exchanges my only concern". Do you now have others?

As to the bolded, I dont think anyone here begrudges that sentiment. No one has opposed that in general, or as an overarching end result.

The issue is for at least 3 of us is *how* that result is implemented. Criminy, even #s identifies that avenue as potentially an overbroad means -- and in fact criticizes the Republicans for going down that path.

I dont like overbroad and/or vague laws for *any* subject. Whether it be men in sexy drag stuff making lewd stuff in front of children --- *or* something else like gun restrictions.

Progressives have made a field day in trying to get expansive as **** results in overbroad and vague laws. Its a load of crap there.

In that instance all it takes is one ignorant progressive peckerhead law enforcement official to achieve what *their* heart desires in gun restriction, and to the detriment of otherwise innocent activities that the ignorant progressive peckerhead thinks should be the case for punishment.

My stance is that the form to regulate the actions you want regulated (and to which no one really disagrees here that they shouldnt. And do it in a way that a peckerhead ignorant right wing jerk wishes to achieve to the potential detriment of otherwise legal activity.

Quote: You on the other hand, in the interest of protecting a miniscule and deranged segment of society, appear not to care about the safety and welfare of innocent children.

Nice strawman. Just because I disagree on *how* to achieve that result doesnt make me not want that result. Please stop with the really shallow strawman stuff. Ill keep it to the friendly tone there.

Im sure you are happy that the pistol brace rule was ruled 'arbitrary' and 'overbroad' recently. I guess you like those types of laws and rules being challenged for that in one instance, then go off and support them fully in others. Yippee.
[/quote]

Hey, I'm simply taking a page out of the lefts playbook. And yeah yeah, I know you aren't a leftie.

As to the pistol brace rule having been ruled on I wasn't aware of that. I know in a crushing blow to the ATF the northern district court in Texas just yesterday issued a preliminary injunction over the ghost frame receiver rule. I think you may be confusing those two. However, the issuance of that PI speaks to the complications the ATF will face over implementing the brace issue.

Apparently that rule didn't pass the 4 step smell test a judge uses when considering whether or not to grant injunctive relief; Plaintiff(s) demonstrated a substantial likelihood of success on the merits of the case, plaintiff(s) demonstrated that a substantial threat of irreparable harm existed to plaintiff(s), plaintiff(s) demonstrated that the balance of hardship weighed in favor of the plaintiff(s) and finally that the issuance of a PI didn't disturb the public interest. I believe I have those right.

In my uneducated mind the ATF rule about braces isn't an issue of a vague or overly broad application or definition, it's about the issuance of such a rule, however it is defined, in the first place.

RE: TN Bans Most Drag Shows
Tennessee Federal judge grants TRO blocking enforcement.

https://storage.courtlistener.com/recap/...1.26.0.pdf

Quote:If Tennessee wishes to exercise its police power in restricting speech it considers obscene, it must do so within the constraints and framework of the United States Constitution. The Court finds that, as it stands, the record here suggests that when the legislature passed this Statute, it missed the mark.

Quote:Ultimately, the Statute’s broad language clashes with the First Amendment’s tight constraints.

Quote:the Court finds that the Statute is likely both vague and overly-broad.

Noted in the decision was following, "Plaintiff proffered unopposed evidence to support its contention that other civic groups are also concerned about the Statute’s vagueness and overbreadth. (ECF No. 23.) A notable example is from Mystie-Elizabeth Watson, Producer and Director of Absent Friends, a theater organization that hosts a monthly showing of the movie, “The Rocky Horror Picture Show.” "

Also:
Quote: During the hearing, Defendants agreed with the Court’s observation that current obscenity laws already account for much of the conduct that the Statute seeks to punish. When the Court asked exactly what conduct this Statute reaches that is outside the scope of Tennessee’s obscenity laws, Defendant initially answered that the Statute adds very little, and later clarified that in their view, the Statute is a time, place, and manner restriction. But this answer raises more questions for the Court as it does little to advance Defendant’s position.

World class mischaracterization from you above.

If you bother to remember, my concern was that the law was 'vague and overbroad.'

Again --- world class mischaracterization from you. Imagine that. Lolz.

You just always seem to be on the wrong side. The side defending the onslaught of the progressive marxist. Not saying you’re a disciple of the left. Just a tool of them. Why not offer an alternative?

Wrong side? Not the first time I have heard being a very staunch defender of the 1st Amendment being the 'wrong side'. The issue for me isnt 'lets keep the subject videos legal' -- the ones in this thread actually do make that clear.

My side is 'dont be a dork, and thrown down a law that has 1st Amendment problems' as the solution.

Not the first time I have typed this. Apparently your assumptions are a tad (read wholly) incorrect.

Alternatives? I offered 2 here.

1) Try not to go with the very broad, probably overbroad law as the attempt to discourage the highly problematic activity. Try ones that are specifically tailored to the issue and not on their face seemingly are prone to run afoul of basic 1st amendment issues.

2) I thought this was noteworthy, by the judge, and agreed by the State: "During the hearing, Defendants agreed with the Court’s observation that current obscenity laws already account for much of the conduct that the Statute seeks to punish."

But push those buttons in a blind manner how Marxist I am. Good grief....

How is being a staunch supporter of the 1st Amendment a 'disciple of the left'? Use that bit of grey matter than sits between your ears and actually read what I say, and try to repeat my comments instead of making stuff up.

Perfect is the enemy of good. I suspect some of the vagueness was intentional.

It's Ok Tanq just admit you like you some "drag queens"

It will get through this hurdle

The person worried about Rocky Horror Picture show is just a dummy. That already has a rating and is covered in the law. Unless they are of course letting kids in to watch....im sure they would never do such a thing.

Argument by mischaracterization is a bad loo there, Maximus. Just saying.

Where exactly is it covered 'in the law' and for purposes of Tennessee law?

Apparently the Federal judge in the case doesnt agree with your argument about that. Funny that........

Unfortunately vagueness can also be the enemy of 'constitutional.' As has seemingly occurred here.

Yes it is,

Tennessee Code 39-17-907, enacted in 1989, states, "...viewing a motion picture designated "R" for restricted audiences, persons under eighteen (18) years of age not admitted unless accompanied by parent or adult guardian..."

Violating the law is a Class A misdemeanor, punishable by a $2,500 fine and/or 11 months and 29 days in jail.
