And you think such a position is rational and fair when 65-70% of divorces are initiated by women? Each custody case should be evaluated on its own merits.
I think unless there is a compelling reason *NOT* to leave the kid with mom that's where they should go... Life is not supposed to be fair by the way. Part of the spineless character which we are breeding into kids is that life should be fair.

That is where I vehemently disagree. My ex-wife was allowed to move my kids 90 minutes away from me because the court was concerned if I got full custody that she wouldn't be a part of their life in the same way they knew I would (came from the mouth of the guardian ad-litem). So, because they deem me as someone who would be completely involved in the lives of my kids wherever they live, I get screwed. Granted, they did offer me 3 weekends a month and equal time when they are not in school, but the point of the matter is that both sets of grandparents are 10 minutes from my house (the house the kids were born in and we lived in together) and their only cousin is 20 minutes away (my nephew, not hers).

True. But in this instance the father left the marriage, and is doing his kids no favors.
That he left the marriage could just as easily be a sign of her problems as much as a sign of his. She could easily be an abusive alcoholic, and that's why he left her and got the kids. Everything I know about family court, which admittedly isn't a whole lot, makes me assume there was a reason this mother didn't get the kids. Courts aren't keen on taking kids away from their mother or moving them, and unless there are reasons otherwise, that's usually how it results.
Which, is unfair, because I know plenty of fathers who were far better parents than their wives/mothers. There's a lot more to being a good parent than what's between your legs.

I pay child support and my ex uses that money for her retirement accounts and to take cruises. I still pay for the kids' food, clothing, medical, athletics, contact lenses, college tuition, etc. I'm living on 30% of my salary for my mortgage, car payment, etc.
To hell with women and their whining.

I appreciate your thoughts, but I've had two lawyers ... one male and one female. They both said in Texas the man *always* pays the woman, unless the woman has been convicted of selling drugs. And the courts don't care about me paying for all of the kids' clothes, athletic expenses, and music lessons (in addition to the routine child support).
