California gets rid of money bail....
still racist according to the ACLU

Quote:California will end the cash bail system in a sweeping reform for the state. Rather than requiring defendants to pay in order to be released before trial, their release will hinge on an assessment of their risk to public safety.

RE: California gets rid of money bail....
They should just get rid of jails all together. Make the convicted wear T-shirts stating their crimes. Can't be less effective than most other moonbat things California is trying these days. California is quickly becoming as bad as prison but without the free meals.

FYI, the criminals won't be allowed to leave the state during their term. Have to protect the rest of America from Moonbatland.

RE: California gets rid of money bail....
This actually makes some sense.

There's ample evidence that our legal system is requiring jails to sometimes act as debtor's prisons for poor people. If Bill Gates, me, and a 20 year old laid off high school dropout all get speeding tickets, we are all assessed the same fine. But the unemployed person will frequently go to prison for it because they can't pay the fine.

At the very least, bail levels should always consider the defendant's resources. I think that's ignored more often than not.

I can see some merit in this but I don't know if I would have gone that far. Poor person and rich person get charged for same crime. Poor person cannot afford bail and is stuck in prison pre trial, which makes preparing a defense incredibly difficult. Rich person is out on bail and can more freely assist and contribute to his/her defense.

It will be interesting to see how it plays out.

What a dumb ass position to take, You know what stops criminals from having to provide bail money? Stop engaging in criminal activities. You freakin liberals amaze me.

RE: California gets rid of money bail....
My experience is purely anecdotal, but I've yet to see a situation where the financial wherewithal of the accused WASn"T a factor in setting bail. Of course there are guidelines in that you won't have a $1mm bail for a traffic ticket or a $100 bail for murder, but we've all heard of ranges of a few (tens of) thousand to millions for murder.

said generally... may not be precisely true... The defense asks for bail, the people ask for an amount, the defense accepts or counters, the judge decides.

But you also have to consider that someone who is wealthy, with vast financial holdings and connections to the community etc etc etc has far more to lose by running than a homeless person... so I'm not sure how this really addresses the issue. SOUNDS good, but the alternative is just as risky

I imagine we'll soon see means tested fines in California. If you get pulled for speeding in, say, Norway and you're filthy rich ... your fine could easily be over 50,000 Euros.

Probably the vast majority of the time, yes. They are automatically suspect in any case.

Then you'll usually be exonerated and your bail money returned. Otherwise, it's an inconvenience of having a system of justice based on the rule of law and an event that likely doesn't in general occur to any significant degree. Although, I don't know that to be true and I'm sure the wrongly accused aren't concerned with how often such an event might or might not occur in general.
