You picked up on exactly my point.

The NC law revolves around LEGAL gender, which is determined by the registars office in the locality of your birth, regardless of where you live currently.

Here's the issue. This is the law in North Carolina as it stands now

1) Born female, male gender identity and presenting as a male, before surgery, born in California - Use the mens room (California allows legal gender changes before surgery)
2) Born female, male gender identity and presenting as a male, before surgery, born in North Carolina - Use the ladies room even if breastless and having a beard (NC doesn't allow legal gender changes before surgery)
3) Born female, male gender identity and presenting as a male, after surgery born in North Carolina - Use the mens room
4) Born female, male gender identity and presenting as a male, after surgery born in Kansas, Idaho, Ohio, or Tennessee - Use the LADIES room. Even though they have a p.nis and present as males (because they are).

This law doesn't keep men out of ladies rooms. It mandates it in many cases. It also will do nothing to stop sexual predators and peeping toms from spying on ladies in the restroom.

The people who get busted in public parks, restrooms etc. are almost always 'closeted' men with wives etc. Or people who for whatever reason, wont come out of the closet.

Out people have much better options than the restroom at the mall.

Either way, in the last two decades the growth of apps like Grindr, Tindr, Scruff etc. have allowed people to connect discreetly. The restroom cruising is pretty much a thing of the past.
