you do know that plea bargains don't include a set jail sentence. The prosecutor and can promise to recommend a certain sentence, but it is ultimately the judge that hands down a sentence. The judge in this case was a Bush appointee for the record.

You do know when you dump 54 of the 55 charges and leave only a very small charge, there is very little a judge can do. I don't think he had priors, so a first-time felon with the recommendation from the prosecutor for probation, is probably going to get probation. He was only charged with one count of illegally purchasing a firearm with a false id and there isn't really anything else to go on.

Regardless, this case isn't about a judge, but about a prosecutor that dropped almost all of the charges. If people like Obama are really concerned about strawman purchases, then prosecutor the hell out of guys like this before you start making new stupid laws.

OMAHA, Neb. (KMTV) - Omaha’s police chief is speaking out in response to a Georgia woman’s sentence for buying the gun that was used to kill an Omaha officer.

Chief Todd Schmaderer issued the following statement in response to Jalita Johnson’s sentencing:

"I am disappointed in the court's decision to sentence Jalita Johnson to one year of probation for the illegal purchase of a firearm that was used to kill Officer Kerrie Orozco. Illegal straw purchases, like this one, is a well documented manner in which violent offenders obtain their firearms. Straw purchases are a link to the gun violence that has damaged our community over and over, and the court missed an opportunity to make a bold statement."

His statement echoes a similar response shared on Facebook by the Omaha Police Officers Association Tuesday.

“The members of the OPOA cannot begin to express the amount of anger, frustration, and sadness this news brings to us,” OPOA wrote.

Johnson must serve a year of probation, 180 days of home confinement and community service.

Investigators said she bought the gun used to kill Orozco at a pawn shop in Jonesboro, Georgia, and gave it to Marcus Wheeler, a convicted felon. Omaha Police described it as a “straw purchase,” defined as a “criminal act in which a person who is prohibited from buying firearms uses another person to buy a gun on their behalf.”

Quote:Jalita Jenera Johnson, 26, of Jonesboro, pleaded guilty to lying during the purchase of a gun Wednesday before U.S. District Judge Eleanor L. Ross in an Atlanta federal court.

In April, Johnson bought a Glock pistol, 50 round drum magazine and ammunition from Arrowhead Pawn Shop in Jonesboro, Georgia for her boyfriend Marcus Wheeler, a known gang member, drug dealer and convicted felon.

Wheeler later used the gun in a shootout with members of the Omaha Police Department’s fugitive task force that left Det. Kerrie Orozco dead just hours from completing her last shift before taking maternity leave. Wheeler later died from wounds received in the gunfight.

The day of Orozco’s funeral was originally the due date for her baby, Olivia Ruth, who was born three months premature.

“Laws which prevent convicted felons from buying guns are designed to protect the public,” said U.S. Attorney John Horn in a statement. “This defendant helped a convicted felon circumvent those laws. The tragic consequences and loss of life in this case reinforces the reason we have such strict laws in place.”

According to Horn, Johnson purchased the gun used in the shootout under her name with money provided by Wheeler, lying on Bureau of Alcohol, Tobacco, Firearms and Explosives paperwork in an illegal straw buy. On the paperwork, she affirmed the pistol would be hers, when in actuality it was bought for Wheeler who – after spending five years in federal prison on drug charges – was a prohibited firearms possessor.

In the days immediately after Orozco’s death, gun control groups blamed Georgia’s gun laws for Wheeler’s illegal firearm, despite the fact Johnson’s purchase was a clear violation of existing federal law.

The NRA spokesman did a good job of ripping him as well, saying how he has just released gun law violators in a massive early pardon, and went on to show how all of the recent gun incidents (Newtown, San Bernadino, Giffords, etc) all happened with guns that passed through background checks.

I fully believe that is all by design. They want the problem to be guns so they can disarm citizens.
