You have to be able to show damages to win a lawsuit. The guy has had no property damages. He didn't fall. He sustained no injury. He cannot sue for punitive judgements without some actual damage. No respectable physician is going to be able to make a claim that the guy is going to have to miss work for this. There's just nothing there to sue about.
Maia, assault is a criminal court issue. You can't file a civil suit because somebody committed a criminal act. You have to show damages from that act you're trying to recoup. There is no case here. No harm can be shown

It has nothing to do with damages when assault is concerned. Even a threat can be enough to get you a fine or jail time (under a year).

Only in a criminal suit. The guy isn't getting arrested (that I can tell), so that only leaves a civil suit.
I want to know what the guy said before I crush Smart. No excuse for doing it but if the guy dropped an n bomb or something like that I could at least kind of understand him losing his cool in the heat of the moment.

Smart is almost certainly done for the year. While I know people are going to say no excuse for what he did, fans can get completely out of control. The higher standard should go both ways. From the video, it looked like a very good chance that at least the ladies nearby were saying some disrespectful things and one was clapping in his face.
