Actually, her TRO pointed out, using Trump's own public untruths, that the basis used in the order was simply a lie.

Kind of easy to point out the abject lies in the Trump statements preceding the attempt to Federalize the Guard. Funny that.
She also noted the very obvious shortness in the recitation of facts by the US proferred in the filings. And how that level of proof and evidence didnt match in weight the actual evidence presented by such things as, well, actual communications within the State of Oregon on the issue, and the provable level of unrest present matched those communications where State officials decided that they did not feel the need to call up the troops.
Quote:Defendants’ declarants describe only four incidents of protesters clashing with federal
officers in the month of September preceding the federalization order—on September 1st, 9th,
12th, and without further specification, the second week of September.
Quote:The first involved protesters setting up a makeshift
guillotine to intimidate federal officials; the second involved four people shining overpowered
flashlights in the eyes of drivers; the third involved someone posting a photograph of an
unmarked ICE vehicle online; and the last involved additional drivers having flashlights shone in
their eyes.
Wow, four isolated incidents. Quite the fing national emergency that requires the military, or troops being called up.
I guess four single incidents is enough to alarm the Trump WH into a national emergency situation requiring either military troops of the mobilization of Guard. Pretty amazing breach that the Feds seemingly cannot handle. The horrors. Lolz.
Facts are your friend. Kneejerk characterizations may not be.
Ok, enough of this. You may be a brilliant lawyer, that's debatable. But at a certain point when the law doesn't serve justice it's time to a) abolish the law(s)
That is absolutely a valid path. Its one that I think the opponents of the 2nd amendment should use as well. Instead of trying to ignore it out of existence.
Quote:or b) if the law can't be repealed and it is still causing harm then some have no choice but to ignore it and understand that it breaks the barrier between what is legal and what is just.
In that view you are no better than the progressives you continuously denigrate. its just that you and them differ on which laws you think should be absolutely ignored, from your stance above.
And begs the question, what other laws should *magically* be ignored? And the *real* funny thing, is your comment about 'ignoring certain laws you dont like' puts you in the *same* boat as Antifa -- just different laws. Just below you went on a charge (and I quote) "if they have their way there will be no laws, they will mete out their own justice". And literally right above you seemingly support ignoring the law and meting out your own justice. Exactly what you detest about Antifa directly below.
Quote:If the fools that you are defending
TB, Im defending no acts of violence. Charge them.
The issue isnt 'defending violence' --- the issue is when you send in the 82nd Airborne?
Quote:have their way there will be no laws, they will mete out their own justice and you'll be unemployed.
Again, the issue isnt 'defending violence' --- the issue is 'when do you send in the 82nd Airborne?'
TB, with respect, I think you (and lot of people here) are debating a stance that literally has almost nothing to do with the question above. The default from you above seems to be that 'this is defending Antifa' and somehow this might lead to 'if they have ther way there will be no laws'.
Each of those -- when there is violence committed against civil authorities, of any sort, or the populace --- charge them. At the present there is no need to throw the military against them. No matter how many times our President has or continues to use the evil bugaboo of 'Antifa' and 'domestic terror' to whip up a frenzy.
The only metric is a) how much violence occurs in a given locale; and b) are the fed and local authorities able to manage that. If a) is much larger than b), and devolves into the complete or almost complete absence of either civil authority, or devolves in the Feds being completely or nearly completely unable to effectuate Federal law -- then the use of the Guard via callup or the use of the Insurrection Act is proper. And then send them in.
Thee above is what distinguishes our Constitutional system and order from a large number of ****** tinpot authoritarian systems. And till now its worked well to keep us away from that.
If you think that instance of violence are manageable justify sending in the armed forces, what side of the line of that 'authoriatarian / rule of law' does that put you?
Quote:Throw off that lawyer cape you think gives you superpowers and look at this from the perspective of an average citizen. The crime and lawlessness that goes on unabated despite "best efforts" is right there in front of you and you're going to defend the criminals? GTFO.
Unabated? Seriously, look at the judicial records and evidence presented BY THE US in the current cases. Im sorry, the actual proved up record, even the best one presented by the DOJ in both the Oregon *and* Illinois seriously contradict that statement above of 'unabated'. Or is the DOJ lying about the amount of incidents in the record, and the very clear record that it is manageable, simply to take a bagger and lose the cases?
Quote:I would love to to be able to rely on the police to do their jobs but too often they are either riding out the days until they can retire, they do the least they can get away with, or their administrations have their hands tied so tightly behind their backs they are powerless even if they are conscientious.
So you are in favor or martial law, and the ability of the Feds to call up the military for domestic use on a whim? Is that your position from above? Not trying to be antagonistic, but I am trying to find out exactly where you stand on this.
Quote:Use your common sense and stop favoring the perps over the victims.
Your comment there is bit over the top rhetorically speaking. No one is saying 'favor the perps'. They are saying there is a reason why there is a massively high bar for the President to send in the military . At least for those that arent pure MAGA.
