Donald Trump’s Nov. 26 sentencing in his New York hush money case was adjourned
Quote:Donald Trump’s Nov. 26 sentencing in his New York hush money case was adjourned by the court as the judge weighs how to handle the prosecution in the wake of the former president’s reelection victory.

The sentencing was called off without explanation Tuesday in a short note by the court. The update on the court docket came on the same day that Manhattan District Attorney Alvin Bragg faces a deadline to give the court his recommendation on how the case should play out.

Whether Justice Juan Merchan decides the hush money case should proceed to sentencing, gets delayed for four years or is simply dismissed outright is an open question hanging over the president-elect. Trump’s attorney said in a letter to the court last week that there strong arguments for dismissal, while Bragg’s office said the jury’s verdict must also be considered.

Merchan just can't let go of the damn case. He wants to stick it to Trump, but he can't figure out how to do it without getting in hot water.

This.

Merchan’s overriding objective is the same as it has been from Day 1: to inflict as much legal, political, and financial harm on Trump as he possibly can. In order to find a way to do that, he will leave this case on the stove for as long as he possibly can without drawing the negative attention of NY’s appellate courts. And since those appellate courts are mostly anti-Trump, too, that time will probably be several months.

Can't Trump's lawyers file something against Merchan showing that by continuing to postpone this, Merchan is violating Trump's Fifth and Fourteenth Amendment rights in order to get Merchan to make a ruling? Boy, I wish a certain lawyer was here to tell us where I'm wrong in thinking that. (You know, even though he's been proven wrong every single step of the way. lol)

Yes, the problem is, at what point does the judicial delay bump up against those Amendments? I admit I don’t know the answer, but I can think of many instance where sentencing did not happen for more than a year after the verdict. Generally, so long as the Defendant is not in custody the courts do not consider it a problem. But of course, “generally” most defendants *Want* to postpone the sentencing as long as possible, while the prosecution (with the agreement of most judges) says it’s time to sh¡t or get off the pot. Here, of course, the roles are reversed.

If he dismisses the conviction, MSNBC cannot call him a convicted felon anymore

He is not a convicted felon now. You have to be sentenced first.

I just learned via Fox News that prosecutors in the case are asking Judge Merchan to pause the case so Trump's lawyers can file for dismissal.

Wow. Even the prosecution sees the writing on the wall. This will all be on Merchan now if he insists on prolonging it.

Not what I'm seeing. The chryon on the screen right now literally says:

"NYC DA opposes dismissing Trump conviction"

And the ladies on "Outnumbered" are debating it.

Maybe I misheard what Harris Faulkner said. My fault. Also, if they're asking to delay it until after Jan. 20, 2029, that would be a violation of Trump's Fifth and Fourteenth Amendment rights as well as the Supremacy Clause in the U.S. Constitution.

100%

He deserves the right to appeal and that is at a standstill right now.

Judge needs to either dismiss or sentence so appeal can proceed.

What the actual **** is wrong with these people?

Dismiss or sentence him now so that he can appeal all of the garbage that took place in a case with a bullsh!T legal theory.

State case but the state case was based entirely on federal statutes so bet your rear end he'll pardon himself come January 25th and let them try to fight that in court. They know this. Thus, seeking delay until he leaves office.

This whole lawfare episode sure exposes how corrupt and biased some in the legal system are.

These people are a disgrace.
