1. Sure they would, assuming one of the WAC TX FB universities was deemed "worthy". MW wants a TX presence again, their front range schools need it (recruiting, TV money). Also preventing an FBS WAC from being a part of the new contract means more money for them (and the other FBS conferences).

2. Agree, which is why I don't get why everyone is all tied up on the new contract timing. The lawyers would sort all that out and I think it would favor any "new" FBS conference that would come about.
