Foreigners don't vote or pay taxes normally in the US. They are still collecting information on US citizens so there is a lot of potential to look at that information later on. Some would consider the retention of information spying, whether anyone is actively looking at it or not.

Just saying countries have been spying on each other in modern times since way before the Cold War. These countries acting in bewilderment in finding out the US spies on them is silly. They know it happens. They do it also.
