Court overturns California gay marriage ban
Prop 8 found unconstitutional

San Francisco, CA — Chief U.S. District Judge Vaughn Walker of San Francisco today has ruled that California's gay marriage ban is unconstitutional, according to CNN.

At issue is Proposition 8, a controversial ballot measure approved by California voters in 2008. Prop 8 passed with 52 percent of the vote and defined marriage as being between one man and one woman.

Jeffrey Zarrillo and Paul Katami from Burbank and Berkley couple Kristin Perry and Sandy Stier filed the challenge to Prop 8 in an effort to overturn California's ban on same-sex marriage.

The plaintiffs were represented by former Republican Solicitor General Ted Olson and Democrat David Boies during the 13-day trial.

AFER, the organization that launched the case, will hold a press conference shortly at The Bentley Reserve hotel in San Francisco. The press conference will be carried live at equalrightsfoundation.org.

Today's verdict will likely be appealed and may ultimately reach the U.S. Supreme Court.

Two things here:

1) A San Francisco court the odds of an objective judge in that city on this case are slim and none.

2) This is a STATE constitutional matter, since when does da Federal Gubment have any business ruling on a state constitutional matter?

Hopefully it gets there and they decide that the federal government has no reason to address marriage. If we'd get rid of income taxes then I can't think of anything else that entangles the feds into marriage.

I wonder if the original intent of the authors of the Equal Protection Clause way back in 1866 was to legalize homosexual "marriages". The entire concept of people of the same sex getting "married" didn't even come into existence until 135 years later. Judicial Activism at its finest.

Homosexuals have the ability to marry a person of the opposite sex, just like everyone else.

Marriage is essentially a contractual agreement with the government...otherwise you would not need a license.03-idea

I would submit that those that oppose the gays being able to enter into the same contract as them...start opposing the governmental licensing contract...otherwise STFU about it.

It amazes me that with all the REAL problems in America...People are worrying about the gays...03-lmfao I welcome the gays into my community with open arms....I live in a very $hitty town that could use lots of them to make it a better place to live. We could use their skills in renovating crappy homes and making property look as if people care about it.

Actually gays need to STFU. As long as they don't get in my face, my children or grandchildren face I'm fine with it, when they parade their junk bs in public, I got a problem. No one cares if they shack up, no one cares what happens behind their closed doors. If they quit making unreasonable demands they would be just fine. They should just STFU and get on with their lives.

Couldn't be more WRONG about marriage being a contract with the gubment. The gubment took a religious institution and made it a gubment one. If the gubment wants a institution LIKE marriage call it civil unions, oops they already did and that wasn't good enough for gays. If civil unions are good enough the gays should SHUT UP!

So you do not have to have a license in order to be legally binded with a spouse? I get your point..but..is very much is a contract now.

I actually agree....I would submit that we all would be better off if we concentrated on the improvement of ourselves. We would have far less time to worry about what others are doing.

Ok, tell me precisely what I can do that gays cannot do. Tell me how that the current provisions that are identical for US citizens are suddenly not "equal".

You can't get much more "equal" than identical.

A gay guy doesn't have the right to see his 20-year partner in a hospital if the other is seriously hurt in an accident.

If he had a signed piece of paper, no one could stop it. (in 20 years of civil union. they might have gotten around to it) How about they take care of that little problem instead endless court challenges.

No such thing as a gay civil union on Georgia.

Once again a group does in the courts what they can't do at the ballot box. 7 million votes overturned by one guy. Totally screwed up.

I suspect this could be easily changed within the existing legal framework (power of attorney, etc.) and I'm not opposed to civil unions if it simplifies matters further.

Nevertheless, it doesn't answer my question at all...how are the current provisions not applied equally?

Fact is they don't want equal treatment, they want special treatment.

All gay people don't think the same. The ones I know aren't the ones showing their asses on Broad street while wearing pink boas.

Torch, I'm not saying I'm for gay marriages. To be honest, I don't want ANY marriage recognized by the federal government because it's none of their damn business.

I was referring to the "Broad St" gay parade.
