Well, it's in the fourteenth amendment of the Constitution, so it being upheld was more or less a foregone conclusion. Only way to change it is to amend the Constitution.

If it was only meant to apply to slaves they would have written it that way, which would have been exceptionally easy to do. It sounds like you want a more "living constitution" view of things vs strict textualism, or in reality you just have ideas of how you want things to be and then want the judges to work backwards from the results you want with their rationale.

The backlash to this will be glorious.

It is not over.

Start making visas impossible to get.

Just enforce the laws with rigor.

I still like my idea of enforced vasectomies and hysteroectamies (SP?) prior to obtaining a VISA, h1-b or any other travel plans.

Don’t let obviously pregnant foreign women into the country. Maybe ask if they’re pregnant on the Visa application. The Left would likely try to use HIPAA laws against that but foreigners don’t have HIPAA rights.

Stop chain migration and limit anchor babies by being tough at the border and as they attempt to enter the country through immigration.

Guam is the loophole. Got to stop the Chinese from exploiting Guam.

He seems to be describing one class of folks -- people "who belong to the families of ambassadors or foreign ministers".

Quote:foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class

You are so wrong on the reading of this...

A) Foreigners
B) Aliens
c) Families of ambassadors/foreign ministers (Which would never be referred to on the floor as Foreigners or Aliens)
d) and every other class of persons

So in your view, Howard includes *everyone*. A-D make up the entire population of the world. Cool.

Quote:(the wording of his statement on "d', means he must have been referring to multiple classes of people previously, not 1 individual class of persons.)

I guess you missed the 'will include' and the 'does not include [d]'. Your entire explanation above is bolloxed since you missed the term 'will not include'.

And no, instead of making up context as you do - refer to the total in the original. He was not referring to others previously. Nor had he. Please dont make things up.

Here is what said -- what is *not included* is one set of persons -- the general notion that everyone who adhered to 'droit du sol' (or the soil controls citizenship). That is foreigners, aliens who are are ambassadors or consul. The general rule of droit du sol.

Everyone else (in this case everyone in the United States *except* the group named) *is included*.

Literally -- chart the sentence. The lack of conjunctive words is telling. The fact that you have to make up conjunctive words imparting formal logic is also telling.

Quote:In fact, he Did clear up what he said:

Howard clarified his statement during the original congressional debate over the amendment describing the clause as having the same content, despite different wording, as the earlier Civil Rights Act of 1866, which reads: “all persons born in the United States and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States”. He said of the exclusion of Native Americans who maintain their tribal ties:

In fact the fact he added Indians as another CLASS of persons to whom he would not grant authority even though they were born on US soil.

As children of foreign parents, birthright children were subject to a foreign power (through their parents).

You say he 'clarified his statement'. What did he say *exactly* to clarify it? You seemingly omitted that important aspect of *what* he said.

Quote:Which further clears up this thoughts on birthright citizenship.

You havent quoted a single thing that 'clears up *his* thoughts', mind you.

Your bald unsupported assertions do not 'further clear up his thoughts'.

Sigh. Dude, *even if* Howard thought 'persons not subject to the jurisdiction of the United States' -- the real test of the issue is what the people that *voted* on it and in the positions of power thought of it.

As an example -- lets say I author a bill that says 'the US Treasury will pay everyone 20 thousand dollars, right now'. I make a comment that *my view* is that 'everyone means everyone *except* people with the word 'Saint' in an online nickname.'

It doesnt matter a rats ass when the bill is passed with the term 'everyone'. Just because I dont think a broad term includes you doesnt mean squat. What is important is that a broad term was used.

Again, the Congressional Record is replete with numerous instances of discussion on the phrase *by the people that voted for it* -- and Howard very well knew of those discussions. He was a participant in them. The people that voted the issue in almost to a unanimity were of the opinion that the phrase was exactly as the majority held today, and that of the leading case on it prior decided in the 1890s.

The exact issue was brought to the attention of the broadness of the phrase in normal English. Did Howard amend the bill to clarify his point (as you make the case above of this raft of clarifications)? No, he didnt bother to amend the language to express that concept which you claim he said it meant. To the people voting on broad as hades language.

He knew the broad, common meaning. If he had meant something as so much different than the broad, common meaning, he would have amended it. As such, there was no amendment. ANd the broad phrase was intact. With reams of evidence from those that voted on it that todays interpretation (the broad, general one) was the concept that they approved. There is ZERO evidence that the people who voted on it believed in the word / phrase / dictionary contortions that you ascribe to it. Zero. Nada. Nil. Nothing.

a) Literally -- chart the sentence. The lack of conjunctive words is telling.

I did chart the sentence...

item 1, item 2, item 3, item 4. but not Item 5

Btw.. But does count as conjunctive word...

Item 1 , 2 and 3 and 4 all refer to specific items, (foreigner, alien, families of diplomats and families of Foreign ministers)
but Item 5 = refers to all other classes as a singular whole?

That doesn't work by english logic, you typically compare multiple objects vs. multiple objects, especially in list format, not single object vs. multiple objects.

So you have to consider 1 through 4 as each being independent objects in association with one another; not one long definition that is then compared to multiple objects.

I had this debate with an other English student..they tried to use the claim that 1-4 were all were referring to one subject, and stopped there, but they completely left off the conjunctive part of the argument".

(which you're at least debating, Tanq....so I'll give you that much)

Quote:'the US Treasury will pay everyone 20 thousand dollars, right now'. I make a comment that *my view* is that 'everyone means everyone *except* people with the word 'Saint' in an online nickname.'

this is a fallacy argument.. because you specified EVERYONE in writing and nobody's arguing what the definition of everyone is and are trying to change the language.

Nobody's changing the meaning of any of his words in his quote or in the 14th amendment.

As for clarifying his statement; I put the quote right in the paragraph you said that i didn't include:

“all persons born in the United States and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States”.

We got to this debate earlier over Democrats demanding Clarence Thomas step down due to his "taking bribes" . And they used the "good behavior" clause to claim so, except that in the 1700s they used the term of "Good behavior" to mean "being of sound mind". Modern leftists wanted to change the meaning Of "good behavior" to mean something the founding fathers didn't write.

The phrase is 'born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States'.

There are two groups mentioned in the phrase -- 'foreigners' and 'aliens who belong to families of ambassadors'.

If he had meant foreigners at large, he should have stopped. Aliens who belong to families of ambassadors is merely a subset of foreigners. Kind of senseless to include them in that written phrase.

The only record of the speech is one that comes to us via third party accounts. there is no 1st hand copy of it.

In another sense, the issue can be viewed as 'born in the United States who are foreigners -- aliens who belong to the families of ambassadors.'

That is literally him describing the basic rule of suis sol. Literally at the time, by law, the only sure thing was that those sons and daughters who were born of ambassadors were NOT citizens -- and that they *were* foreigners.

From my perspective he is mentioning one group, and illuminating exactly who that group was -- all fitting on the context of jus soli.

Finally, he says 'those born in the United States who are foreigners.' He makes zero mention of the parents. Only mentions those who are born on the soil. Had he meant what you claim -- he would have said 'those born in the United States OF foreigners.' he didnt do that, did he? There is a huge difference between what he did say ('those born in the United States who are foreigners') and what you claim is being said ('those born in the United States of foreigners').

All he did was recite in form the precise rule of jus soli.

Quote:I had this debate with an other English student..they tried to use the claim that 1-4 were all were referring to one subject, and stopped there, but they completely left off the conjunctive part of the argument".

Im also noting the drastic leap you make with ('those born in the United States who are foreigners') to ('those born in the United States from foreigners')

Quote:
Quote:'the US Treasury will pay everyone 20 thousand dollars, right now'. I make a comment that *my view* is that 'everyone means everyone *except* people with the word 'Saint' in an online nickname.'

this is a fallacy argument.. because you specified EVERYONE in writing and nobody's arguing what the definition of everyone is and are trying to change the language.

And Howard specified everyone as well, with the sole carve out of 'subject to the jurisdiction'. The Congressional record has numerous references to the broad nature of the issue. And Howard never amended. And we have very broad words.

If Howard meant such a limitation, he should have included it. Specifically. He chose the broad phrasing. Bummer.

Quote:Nobody's changing the meaning of any of his words in his quote or in the 14th amendment.

You just did. You just tried to say that ('those born in the United States who are foreigners') to have the same meaning as ('those born in the United States from foreigners'). All the while disregarding the rule in the US at the time of jus soli.

Quote:We got to this debate earlier over Democrats demanding Clarence Thomas step down due to his "taking bribes" . You mean like changing the meaning of ('those born in the United States who are foreigners') to be ('those born in the United States from foreigners')?

Im sorry that offers no clarification in your favor to your reading of it into the 14th.

Sen. Howard expressly noted in the Congressional Record that with regard to the 14th amendment -- "its language was 'simply declaratory of . . . the law of the land already.'" Cong. Globe, 39th Cong., 1st Sess., 2890 (Sen. Howard). Pp. 9–10.

The law of land already was jus soli. Not jus sangre. That is citizenship follows the land, as opposed citizenship follows the blood.

For nearly two decades after the Amendment’s ratification, the Executive Branch viewed the Citizenship Clause as “simply an affirmance of the common law,” with the limited exception of “the children of foreign ministers,” and others “with rights of extraterritoriality.” Memorandum of Secretary of State H. Fish to Mr. Marsh (May 19, 1871), in 2 Digest of the International Law of the United States §183, p. 394.

And the common law was citizenship by birth on the land, irrespective of the nationality of the parents.

RE: Supreme Court / Legal Decisions Thread
Justice Clarence Thomas pens a scathing dissent after the Supreme Court upheld birthright citizenship.

Thomas accuses the majority of “repurposing” the 14th Amendment “to protect its own set of preferred rights that the Reconstruction Congress never contemplated and that cannot find support in its text.”

“Today, the Court does so again by recognizing a constitutional right to citizenship for the children of all foreign birth tourists and illegal aliens.”

“I am not sure that today’s opinion will stand the test of time. The Citizenship Clause ‘added greatly to the dignity and glory of American citizenship.’ Today’s opinion devalues that citizenship.”

“I respectfully dissent.”

Thomas is right

I just don't like the Judicial Activism. This is the refs writing the rules. How hard is it to write a law.
