During the July 30 hearing in which the vote took place, it was revealed that the subpoena had not been complied with.

If the files aren't located where they are supposed to, that is a crime. There are people in the state and the system that have been screaming from the rooftops about what went wrong and where the red flags are. That is why this is happening. There have been hearings in the state in which the evidence of wrongdoing was exposed, but nothing happened.
