Earlier this afternoon, The Commercial Appeal reported that the University of Memphis is investigating a potential conflict of interest as coach Josh Pastner and athletic director Tom Bowen, at one time, shared the same representation. Bowen was the sitting athletic director when Pastner was awarded the biggest contract in the history of the university.

I’ve made several calls and texts to people I trust about this subject and, though it’s a very convoluted topic, will attempt to put my thoughts about it together.

1.) No one that I’ve talked to believes there were any improprieties on the part of Bowen when it came to negotiating the deal. In essence, no advantage was gained by either side because of agency representation....

Bowen negotiated an insanely bad deal for his employer. He included irresponsible provisions he did not need to make and is draining the only profitable sport at the U of M. I bet he hates he didn't get the Cal Berkeley job. Maybe their agent can find a place for Josh and Tom to land???

Agree wholeheartedly. To say Bowen bears no blame for crippling the flagship athletic program is crazy. We can debate who bears more of the blame, but ultimately the president (Raines at the time) and AD are responsible for this situation.

Regardless of who's to blame for this mess, it just points to the total incompetence of all parties at the time the deal was done. The university looks incredibly foolish and at the end of the day, it's all for Josh.

I think the most telling quote in the article is the last sentence of the article:

Regarding the liquidated damages provision in Pastner's contract that allows him to continue receiving his $2.65 million salary if fired, Bowen said he didn't know how that provision got in the contract.

"I wasn't part of that. I wasn't part of those discussions. I just wasn't.''

Not a non-story to me. I'm glad the CA has the stones to investigate. Story was well-sourced and well-written. Have to give credit to the author for getting the agent, Raines and Bowen all on the record.

If it's such a non-story, why is the university investigating?

CA can't win with some people. If we learn later of the investigation, CA is accused of being asleep at the wheel.

One other thing: getting the Bowen quote shows, like Vernon says, that Bowen's explanation has changed.

I'm not a Bowen fan. I think one of the AD's jobs is to promote the programs. We almost never hear from Bowen. And when we do, he is not very impressive.

The football situation is vastly improved, so he deserves some credit for that. But something tells me it was more the coach and the QB.

So Bowen didn’t read the FINAL contract and no lawyer advised him of potential problems? Hard to believe but if true he is incompetent.

You don’t agree to a multimillion dollar contract without legal advice. You just don’t. And if these provisions were somehow added without his knowledge (and maybe others) then the contract could be determined invalid/void.

Another mess on top of the other mess.
