Would You Believe, Another Crashed Hard Drive?
House Oversight and Government Reform Committee Chairman Darrell Issa (R-Calif.) on Monday made yet another request to the federal government for details about a crashed hard drive that may have contained information allowing criminal charges to be brought against a federal official.

Issa’s newest letter concerns the hard drive of April Sands, a former employee at the Federal Election Commission who resigned in the spring after admitting to violations of the Hatch Act. That law puts restrictions on the ability of government officials to conduct political activities while on the job, or from government offices.

Issa noted that while Sands admitted to violating the law, the FEC just recently told Congress that it could not recover her hard drive, which made it impossible to seek criminal charges against her.

“Recent information obtained by the committee suggests that the FEC OIG could not pursue criminal prosecution for the misconduct because the attorney’s hard drive had been recycled by the FEC,” Issa’s letter said.

As a result, Issa asked the FEC to provide information to his committee by July 28. That includes all documents related to the hard drive loss, and documents detailing the FEC’s practices for retaining information on computers.

The FEC is an independent agency, but Sands’ emails clearly indicated she favored Obama’s re-election in 2012. Before the election, she tweeted things like:

“Our #POTUS’s birthday is August 4. He’ll be 51. I’m donating at least $51 to give him the best birthday present ever: a second term.” In another tweet, she said anyone supporting Republicans is her “enemy.”

“The bias exhibited in these messages is striking, especially for an attorney charged with the responsibility to enforce federal election laws fairly and dispassionately,” Issa wrote.

The problem at the FEC is the third high-profile technical glitch that House Republicans have probed in the last few weeks. In late June, Issa’s committee was told by EPA Administrator Gina McCarthy that some emails may have been lost related to a decision blocking a proposed mining operation in Alaska.

And of course, the IRS told Congress it lost more than two years of emails from Lois Lerner, the former IRS official in charge of tax exempt organizations.

this is out of congress' hands. this is a matter for the courts now. the founders never envisioned this sort of rampant lawlessness at the very top of the federal government, and so they didn't build in systemic checks on something they never imagined.

the courts are catching up to it, though. you can dick around with congressional investigative committee, and get away with it by claiming that it's all politics. you can't (always) dick around with a federal judge, and get away with it.

No, simply because I never believed the claim about he first half dozen or so.

So does anyone else see a pattern here? Isn't obstruction still a crime? Or destruction of evidence? Tampering? something?

I'd love to hear the true believers find a way to claim this isn't outside the realm of possibility. As in hitting the lottery, cashing it in and being hit by a bus in the parking lot on the way out, surviving that and being struck by lightening when released from the hospital. Like that kind of possibility.

Well, clearly they're not doing nothing, they uncovered this corruption and coverup as well as the others. Now with that, what would you have them do?

They don't really have prosecutorial or law enforcement capabilities, other than impeachment and ordering the Sargent at Arms to do whatever is within his scope of things. But I think that's limited to only if this political hack shows up on Capital Hill or something.

So, again, it's up to the DOJ and the most corrupt AG we may have ever seen. Perhaps this is the genesis of the latest race baiting by the contemptible withHolder.

I know better than you the odds of something like this happening. If I wake up in the morning and the ground is soaked I know it rained. I don't need to see the rain to know it was not a helicopter and a fire hose.

If we see one, two, three instances where critical data is "lost" just when supposed by congress I don't need to see the act to know it's not chance.

I was also careful to say executive agencies and not "white house" or "obama" because I don't know how high up it goes. I just know it's now across organizations and investigations which indicated either the worst culture of corruption ever or that there is a common fact at some point on the org chart doing this.

When Bush started looking really corrupt I dropped my support and voted for someone else in 2004... I don't carry water tom, but if I did I suspect my posts would look a lot like yours.

Apparently the FEC 'recycled' her hard drive.

I don't know what you think that means, but MOST people would describe that as an executive agency scrambling drives and destroying data. That is precisely what 'recycling a hard drive' means.

If the evidence doesn't exist as you claim, then the emails should exist.

Now, you are free to decide how and why they are doing this, but I'd ask you how old the PC sitting on your desk right now is, and how old the one it replaced was when you replaced it.

It certainly seems suspicious that not only are the individual drives being recycled, but that the back-ups are failing.

That's not how things work where I work. I can still retrieve emails I sent from my yahoo account dating back to 2003, and from my work email address to years before the desktop was recycled.
