Honestly, I think this is where the rubber meets the road. This law is intended to provide you legal cover in the event you get lucky and survive such a confrontation, I suppose.

Obviously Greg doesn't understand the law.

If you know, or SHOuLD know that they actually are the police, then you have no right to fire upon them. This is merely an extension of the right to defend yourself against intruders. The police, acting on a warrant, are by definition, not intruders. It protects a law abiding citizen from being convicted of threatening a police officer by grabbing your gun when you hear a noise... Or from shooting him if he doesn't identify himself. It doesn't make it legal to shoot the police. It merely changes the presumption. If you say you shot the cop because you thought he was a burglar, it is up to the police to show that you didn't... As opposed to assuming you did.. Presumption of innocence rather than guilt. That's all.

The headline is very misleading.. Intentionally I'm sure... And the dumb ones are those that don't see through it

Then nothing has changed... But that isn't the situation. In general, if you shoot at someone braking inyo your house, there's a pretty good chance they're going to shoot back.

There is a reason police must identify themselves. If they fail to do so, and you shoot them as a result... They have to now show that you knew they were police and fired anyway.. As opposed to previously where you had to prove you didn't know.

Amazingly, once again, the people who almost always side with actual criminals... Because ONE mistake is too many... Don't want to give law abiding citizens the same protction

Understand, Greg... That a law abiding citizen looking to protect himself from an intruder is going to pull his gun when someone breaks in.. UNLESS he knows it is the police. Understand and start from a position where this is legal, regardless of your opinion about it. If he doesn't know it is a cop, and it turns out to be... Should THAT result in a murder conviction if you cant prove that in thise 10 seconds, you didnt know they were a cop, Or should the state have to prove that you KNEW it was a cop to convict you?

Proof would be things like police cars... Flashing lights, uniforms... Yelling "Police" and the most important thing in my mind.... Some sort of expectation that the police might have radon to kick down your door in the middle of the night.

Your comment about taking a crack at a cop is absurd. If he is kicking in doors of private homes, he darn well better make his identity known. I'm quite certain your father did this

Just going off the title of the thread (will read more tomorrow), the solution is to reign in and to actually hold the police accountable. Not to encourage a showdown between the public and the cops. This may sound like creating a level playing field, but the police are always gonna be coming bigger, faster, and harder than the people they're going after. Even if you're in the right, all that's gonna happen is your gonna wind up with even more dead civilians and cops.

True. We are seeing an increasing militarization of the police. This is wrong. In the founders day, they wanted the general populaces equally armed. The police should be a constrained force. What do you think would help get that point across to them better than laws like this?

I'm with Rebel on this. Bust in my house unannounced and you're getting shot at. Shoot my dog and someones going to die. If a few irresponsible cops get shot then the rest will surely follow due process.

I'd shoot damn near anyone that harmed my dog. I love that dog more than most people.
