Hard to prove first degree murder beyond a reasonable doubt without a cause of death.

I have indeed, but I didnt feel good about it once I stepped back and thought about it all. We all make hasty and reactionary judgments. Its a character flaw that most humans have. Ive just had a personal experience with a near wrongful conviction of a friend (nothing near capital murder) but it changed his life forever even with a not guilty verdict and no other charges.

Indeed it is. The problem is that they didnt consider anything but capital murder and manslaughter as offenses. They were likely compelled to not include lesser charges since the public outcry was already so intense. Charges such as depraved indifference homicide or criminally negligent homicide would have been much easier to prove. However, to the defense of the state, I dont think they had much of a choice considering the high profile. Go big or go home.

I think that's really it. Too many unanswered or unanswerable questions were still out there for a conviction. Still I think she did it.

Parrish brought up an interesting point. The baby was missing for 31 days and Casey didn't even report it to ANYONE and she went out partying and getting tattoos and stupid crap like that during that time. This is common sense, she is GUILTY!

Guilty of being a horrible mother? Yes.

Guilty of murder? No, evidence was submitted regarding cause of death and who caused the death.

I think she did it also. You left out the part after the 31 days where she sent investigators out on a wild goose chase looking for the nanny-kidnapper that never existed. This woman is off the charts based on that alone.

Too bad that all her lies and keeping the police on a wild goose chase kept the authorities from finding the body sooner and maybe having more evidence against Casey or whoever did it. Maybe they would have been able to figure out the cause of death if she hadn't constantly lied.

I don't think anyone is advocating her as a loving and caring mother. However, the state provided no proof that a homicide had even occured, much less her guilt. No cause of death, no motive, no evidence other than character witnesses and circumstantial evidence.

The worst part about it now is that she cannot be retried for negligence or any other smaller crimes per double jeopardy. They had their chance and had nothing to prove she committed murder or manslaughter. It's their own fault if they still think she did it.

My opinion. It was her lies and the wasted time that saved her. By the time they found the body they were working with something they called "brain dust" inside the skull. Just not much to go with. But at least she was convicted on four separate counts of lying to the investigators. Hopely she'll get the four year max.

Good thread Homeskillet. I agree with you.

For all of you that are caught up in the "she lied about working X" and "went out partying all the time": she wasn't on trial for being a bad parent, bad person or a psycopath. If she was, then she would've been found guilty most likely. She was on trial for murder and murder wasn't proven. Don't get it twisted.

I don't agree with what you seem to be saying by no proof. They didn't have direct proof but they certainly had proof of a homicide. Circumstantial evidence is proof and when added together Casey might considered herself lucky that she got off today. But to continue to say there was "no proof" is wrong. There most certainly was.
