I'd love to see his evidence of declassifying it. But I know, you believe in the whole "he thought it in his head so it was done". There is still lots of processes that kick off when a President declassifies a document.

Stop. Just stop.

No credibility at this point.

The doj has been weaponized against trump from day 1

He broke the law, plain and simple. Whether DoJ was weaponized really doesn't matter at this point. DON'T TAKE US GOVERNMENT CLASSIFIED INFORMATION OUTSIDE OF A SCIF! What is so hard to understand about that? If he did, he needs to be held accountable.

That being said, he's part of the elite class and we know he'll never be held responsible. He has never been held accountable for the first almost 80 years of his life.

The sad thing is that many Americans buy into the bolded and enlarged sentence. "What difference, at this point, does it make?" Thanks Hillary.

I'm not at all a fan of shere kahn's go-to "prog filth" refrain, but this is one time where it may be appropriate.

Donald Trump does not belong in office - - for nearly countless reasons. But he also is an American citizen, and does not deserve to be politically targeted by a Biden Justice Department that has run amok.

Again, not all classified information has to be viewed in a SCIF. Usually only Top Secret (TS) and above.

trump reportedly has NDI information which needs to kept in a SCIF.

We still don't know what Biden had. If he had NDI or TS stuff in his garage, he needs to be held accountable for that. But his situation might also differ greatly from trump. We don't know if Biden intentionally took stuff and kept it...if someone took it at his direction...or if someone just put it there not knowing what they were doing, etc. There normally has to be an intent component for criminality.

Regardless, the case still differs from what we know at this point because Biden consented to searches and reportedly returned everything as soon as it was found.

trump is being treated differently because he did different things!

Fully agree. But that doesn't change the fact that he was caught red handed. Obstruction at minimum, but obviously a lot more serious charges are there.

I'm disgusted by all of this. He should have just given the damn documents back and I don't think he'd have any issues in this case. Why did he keep them when told to send them back? Why did he not respond for months? Why did he have his lawyers state that everything had been returned? Why did he show people the documents who had no business knowing or seeing them?

He actually admitted to the obstruction last night as well.

Baier: You intentionally withheld from the subpoena, and lied to the Federal officers and said you didnt have any documents.

Trump: The boxes held shirts and pants, so I didnt turn them over.

Holy **** -- Doesnt matter that Trump doesnt have to testify and can take the 5th at trial, they have this on tape. Simply play that for the jury.

That interview last night is a defense attorney's nightmare scenario. For the reasons you put forth above mlb, and the above. And three or four more.

I figured, but you said he should not have taken classified information out of a SCIF. Not all has to be in one. 04-cheers

Also, for this indictment, the classification of these documents is really moot. It deals with lying, obstruction, and possession.

He cant declassify the 'concerning US nuclear weapons stuff' (Document in count 19)

That is controlled by the Atomic Energy Act, and the only people that can declassify the document in question by statute is a joint decision by the AEC and the DoD.

Yeah, but he argued last night that all of it falls under the Presidential Records Act. I've seen a handful of people claim that the Atomic Energy Act would be overruled, I'm not a legal or constitutional scholar so I don't know how that would go down in a court challenge.

Can't see how any of this actually applies to the PRA. The PRA is for stuff HE creates. He did not create these classified documents, other government agencies did. They belong to the government.

I don't believe the bolded sentence for one second. It is appalling that Donald Trump is as stupid as he is, and made this a virtual tap-in for the Garland hit squad. But they were going to find something on him regardless.

Donald Trump is a disgusting person. The Biden Justice Department is a menace to our nation.

That's why I said "in this case". He'd be able to show they didn't charge Hillary and others for the same issue. The obstruction is the difference here since he did lie and move things.

Well enough to be passingly familiar with some of the contractors that he cheated via shell-company bankruptcy filings. Well enough to understand what he did in cheating common folk with the snake-oil scam of Trump University. Well enough to know that he hires complete skunks (Michael Cohen being just one example) and then tries to pretend that he is above it all.

Yeah, I'd say I know him well enough.
