That's a really good point (the ASUN could do the same for that matter, though the WAC having more of the membership makes more sense). That's probably why the NCAA hasn't tried to fight it despite the supposed moratorium.
The ASUN has in fact been sponsoring football the past two years, with the WAC programs as affiliates. In the NCAA governance structure, the ASUN has been counted as an FCS conference during that time, and the WAC as a non-FB one.
The governance structure is based on lists of conferences.
On the DI Board of Directors:
10 Conferences get one director each (these happen to be the FBS conferences)
11 Conferences get 5 directors, with rotation among the 11 conferences (these happen to be the FCS multi-sport conferences). CAA is on this list, but it is for the multi-sport conference, not the football conference. The current representative is from the Col. of Charleston. The Big South is on this list despite no longer sponsoring the sport. If the president of Robert Morris or Bryant were on the board of directors it would be as the representative of the Horizon or America East.
11 Conferences get 5 directors, with rotation among the 11 conference. MVC is on this list as is the ASUN. It happens that the representative for the ASUN and WCC are Central Arkansas and San Diego respectively, which both sponsor football.
The Football Championship Committee has a member from each FCS conference that applies for and receives an autobid. So the Ivy, MEAC, and SWAC are not represented on the committee, but the Pioneer, MVFC, and ASUN are. This committee has oversight over the FCS Championship rather than over FCS.
Sorry, I was referring to the D1 Council. Not sure why the Board of Directors hasn't also been adjusted.
The Council is mostly made up of representatives of the All-Sports Conferences, either an AD or a SWA.
There are four commissioners:
Greg Sankey, SEC, representing the 5 FBS A5 conferences
Judy MacLeod, CUSA, representing the 5 FBS non-A5 conferences
Patty Viverito, MVFC, representing the FCS conferences
Dan Butterly, Big West, representing the DI conferences (formerly I-AAA)
I don't know how the commissioner representing the FCS conferences is chosen. It could be by vote of the FCS schools.
The ASUN representative is from Jax U(FL).
The Board of Directives is mostly presidents. The Council is more technical matters since it is AD's and commissioners and is subordinate to BOD.
