Brannen's big shot attorney Mars claimed it...

Quote:Mars claimed Brannen declined to accept a "seven-figure settlement" offer made by UC's outside counsel. Mars also claimed UC denied Brannen due process.

Mars took a low 7 figure offer and turned it to a low 7 figure offer where he gets his cut.

Calling both low "7 figures" is a manipulative way to put it and is indicative of an agenda-based analysis. Despite your original claim, it's still not clear when the original "7 figure" offer occurred as far as Mars' involvement (nor exactly how much that represents.) I have no real idea if Mars did a good job representing Brannen (and I can't say I'm a fan of Mars btw), but there's a pretty big potential difference between $1M and $2.75M.

Dayton's Anthony Grant has hired former Cincinnati and Northern Kentucky head coach John Brannen as program analyst and senior special assistant, per release.

There was no way that goon was going to get a gig that was directly involved with the players until he rehabs his image.

I said his next stop was as a remote NBA scout. This is about the same thing.

Bad coach and a rotten apple. Good riddance.

Yeah but Anthony Grant seems like a quality guy, and Dayton has always ran a quality program ethics and optics wise.

Wonder how long his program analysis system will take to implement? Only 2 seasons for that?

He was on his staff at Alabama and that program had some low rate hijinx going on pretty frequently during that era. He should bring back Dwyer as the video coordinator and advanced metrics coach. Lol. Get the gang that couldn't shoot straight back together.

For what it's worth, Mars is getting some plaudits. This is from a pretty prominent sports-law professor:

I’d be very interested to see the settlement if UC didn’t get the Big 12 invite. Just sayin…

Wait did not one of our geniuses say it would be mostly covered by insurance?

You cannot have it both ways.

RE: Rothstein: John Brannen Hired At Dayton
I'm not surprised to see a sports lawyer backing another sports lawyer. UC offered 7 figures very early on. I've been pretty adamant this thing was getting settled for about half the buyout from the beginning. I didn't think Brannan and Mars would risk court when UC was likely to offer around half the buyout and I thought from UC's end getting it done without forcing players and former players to take depositions for a law suit was worth a couple million.

I believe I remember someone saying that. This is by no means an area of my expertise so I have no clue.

I'd just be interested if that number stays the same without a Big 12 invite which is a hypothetical. My guess is it shouldn't change that number but who knows. When you have more $ it's easier to settle for a higher price.

Regardless, both sides should move on now. Last I'll say is I did not get a good impression of Tom Mars myself. If you want a guy that'll do anything to get you the best outcome maybe he's the go to but seemed sleazy to me from a far.

I don't think Brannen is settling for half the buyout if it was so obvious UC would lose. UC might have lost, but it might have won. There was risk on both sides if this thing went through discovery and to trial.

Brannen didn't want his former players giving depositions any more than the university did. This was a logical settlement from all sides given the risk of not just losing at trial, but for Brannen what could come out from players and for UC the very idea of former players in the program having to be forced into this legal battle on their behalf.

Yep.

Here's the other thing, I am not sure if any of you guys dabble in plaintiff-work, but the getting is pretty good right now for claims against institutions. A lot of risk-adverse entities are paying a little more than they have in the past in an era of nuclear verdicts dubbed "social inflation". The number of 8-figure verdicts are unprecedented right now.
