I'm not going political or into public policy, but guns are one of those things where what is legal in one state can be a felony in another. We have all kind of differences on guns, marijuana, abortion, etc. between states.

I assume the big issue is the gun registered to him?
Social media is blowing up and everyone is jumping to the conclusion that he's a felon and his career is over. I think we all need to pump the brakes and wait until the facts are known.

I'd presume to possess a firearm while not being registered to carry is a bad thing, but altering the identification of said firearm is even worse and a felony no matter what the local laws are.

Yes but is it his gun? Was it altered by someone else….he got himself into a doozy and not the way to get his EMU career going on the right path

We really need to hear more. was the car his? Do we know if he is the 'end user' or possessor of the gun? To whom is it registered? Registered? Stolen?

All of that said, I have NO idea what the gun laws in MI are. Did he get or acquire or register the gun in Tennessee?

One thing I've learned in my 'old' age living in DMV, is that people here can live in D.C. one day; move to Va or Md and stay for a few months and then more to one of the above. (I used to joke that some days, I go out eat breakfast in Va, lunch in D.C. and dinner in Md - I never worried about calculating sales taxes over 3 jurisdiction).

So Emoni has been a recent resident of two very different states... Probably with different gun laws.

Michigan gun laws - Emoni may be ok but NOT the light you want to shine:

(a), the possessor of a handgun must have an unlawful intent to employ it as a weapon against a person in order to make that possession a criminal act. So carry in a vehicle without a permit is legal for anyone who can legally possess a firearm.Aug 25, 2022

You can get a concealed weapon permit in Michigan. If the allegations are true he didn't have one. If the gun was registered to him legally then you don't have to try to hide the guns ID do you? Felony charges are serious business so he may plea down. So what is our AD the University and Heath going to do with the *hit sandwich that just landed on their desks? I can already hear terms like targeted traffic stop and him being pulled over was racial profiling. Fact is he used very poor judgement.

Thanks. I'm surprised by Washtenaw County sheriffs.

Two felonies sounds like way over charging UNLESS there is a story about the GUN, not Emoni. Was it stolen? etc. etc.

So, Emoni is 18, has no known criminal record, etc. Hell, if he signed with Texas he might have gotten a gun as NIL compensation from a gun company. 03-lmfao

The more serious issue is the serial numbers on the gun having been altered. The only reason to alter the serial numbers is that it is being sold illegally and therefore can't be traced back to the original purchaser. There is no way to legally register a gun on which the numbers have been altered (typically ground off). So if you own such a gun, it was purchased illegally. Apart from the purchase, it's illegal to possess a gun on which the numbers have been altered. So it sounds like an illegal gun was in Emoni's vehicle.

Yep - the EMU team needs to release a statement today or tomorrow. With that said oh boy the media is going to pummel this kid and dim the EMU light right after the football team was trying to turn the EMU light on.

Not a good situation even if he is acquitted at some point. The trial may not be for several months so does he play or forego this season…..

Once again, we have to be careful with this line: "Someone was in a car which had drugs (or firearms or whatever), therefore that person is the owner of such."

One problem in criminal justice. Three persons are driving in a car. The car has say cocaine. Who is legally at risk? All three? In some states they will attempt to nail all three. Sorry, "wrong place, wrong time." No mercy.

Emoni Bates has been released on his own personal recognizance. His next court date will be October 6th. His lawyer is claiming that Emoni was driving a borrowed car and was unaware of the firearm.

"Eastern Michigan takes all allegations very seriously," Wetherbee said in a statement to The Detroit News. "We are working to gather more details and will have further comment when more information is available.”

This reminds me of one of the perils of being an AD. Your phone rings at 2 a.m. and your reaction is, "Oh, s*it, I hope..." Could be a criminal matter, shooting victim, fatal car accident, etc.

An athlete who is convicted or pleads no contest to a felony charge “shall be permanently dismissed from the team.’’ The athlete can appeal both the suspension and dismissal.
