SMU boosters form 2nd NIL group, The Boulevard Collective
Earlier today SMU's second NIL collective, The Boulevard Collective, was announced. It will contribute $3.5MM annually to SMU football and basketball, which amounts to $36,000 for each and every player:

I'm curious which school with these blanket "pay every one on certain teams" NIL deals will get taken to court first. Pretty easy to argue it's pay for play and therefore violates Title IX.

From The Athletic article on the same subject:

"Collectives, which are not directly associated with schools, pay athletes for work, as is required by NIL rules and laws. The Texas Tech players will receive the money in exchange for community service, for example. At Saturday’s Boulevard Collective event, SMU athletes assembled more than 400 backpacks with school supplies for Dallas schools. Pony Sports DTX also partners athletes with NIL deals and provides its own inside information."

Memphis' 901Fund does the same thing. Pays players for personal appearances at local charity events.

Where you could make an argument might be if they ever make a rule as to what is "fair market compensation" for work in kind, but we're nowhere near that being standard yet.

Wonder which philosophy leads to more wins.
#1 Paying Top Athletes the Top Dollar, knowing there wont be enough for everyone
#2 Setting a Floor Price for everyone on the team, then attempting to go up for Top Athletes with whatever you have leftover

Personally, I think paying top dollar for the top athletes and assuming others will follow is the best approach. However as a G5, going to a bidding war against Texas or TAMU might not be a winning strategy.

Twitter has answered my question: It's both.

You need 2 Collectives, 1st Collective whose mission is top dollar for top athletes and a 2nd Collective whose mission is setting a baseline payout for every player on the team.

There is just a massive gray area that we won't know the boundaries until it's tried in court.... Which it will be tried at some point. I think these gender specific blanket payments that will do it. Now who is the defendant in that case is a very good question.
