Yes, it would be a SMU style violation if they did this. The schools are not permitted to directly pay NIL, it would be an obvious "pay for play". This is why ALL NIL organizations are setup to operate as independent entities. There is a firewall to some degree between the school and the NIL.

NCAA doesn't have as much teeth on that at the moment for independent donors, but they certainly have authority on what the member schools are permitted to do.
