Its about a second after the gun was visible. There is no way to humanly know he had tossed the gun prior to him turning around.

The kid had a gun and 8 shots was just fired. The kid put his hand behind his back where the gun was.

Kid is dead for two reasons...

1. he had the gun
2. should have put hands up instead behind his back

Lets be honest if this 13 year old is already carrying and firing 8 shots at someone/something. His life wasnt shorten by much it was only a matter of day's or weeks or months.

Another tragic situation. I cant fault the cop, but at the same time.. was the kid turning on him with the gun, or, was he turning and putting his hands up, even though he was holding a gun. It really could have been either, the PO had to decide and hard to blame someone for protecting their life if they felt threatened.

This type of crap that Yahoo puts out is why people believe cops are just killing people. What it should have said "Boy shot after firing 8 shots a couple minutes earlier. Then reaches behind his back where his gun was located, before putting hands up"
