I wonder if having a BLM activist on the jury is grounds for appeal.

RE: Derek Chauvin Trial (BREAKING: Verdict Reached)
Quote:A juror who served on the trial of former Minneapolis police officer Derek Chauvin is defending his decision to attend a racial justice rally in Washington, D.C., back in August, seemingly challenging his statements during the juror selection process.

Though the juror claims the demonstration had nothing to do with George Floyd, the rally in part focused on police brutality and featured remarks from members of the Floyd family.

As reported by The Daily Wire Monday, a Facebook post shows Brandon Mitchell, or juror #52, wearing a Black Lives Matter T-shirt with a reference to Floyd on it. The photo was reportedly taken in D.C., where Mitchell attended a rally commemorating Martin Luther King Jr.’s 1963 “I Have a Dream” speech, and addressing other racial issues.

“I’d never been to D.C.,” Mitchell told the Star Tribune. “The opportunity to go to D.C., the opportunity to be around thousands and thousands of black people; I just thought it was a good opportunity to be a part of something.”

Mitchell confirmed that the social media post showing him in D.C. for the demonstration was, in fact, posted by his uncle. However, he bizarrely claimed that “he has no recollection of wearing or owning the shirt” he is wearing in the photo.

Mitchell also defended his attendance, emphasizing that the march was “100% not” a demonstration for Floyd. “It was directly related to MLK’s March on Washington from the ’60s … The date of the March on Washington is the date,” he said.

However, the Star Tribune noted that the demonstration in part “focused on police use of force.” Moreover, “Floyd’s brother and sister, Philonise and Bridgett Floyd, and family members of others who have been shot by police addressed the crowd.”

The rally “served as a rallying point for the George Floyd Justice in Policing Act, a federal police reform bill,” the report added.

On his juror questionnaire, Mitchell reportedly answered “no” when asked about past participation in demonstrations. Star Tribune reported:

The first question asked, “Did you, or someone close to you, participate in any of the demonstrations or marches against police brutality that took place in Minneapolis after George Floyd’s death?”

The second asked, “Other than what you have already described above, have you, or anyone close to you, participated in protests about police use of force or police brutality?”Related: Report: Floyd Juror Wore BLM Shirt Referencing Floyd In July, Challenging What He Told Defense During Jury Selection

Moreover, when Mitchell was asked by Judge Peter Cahill on March 15, 2021, if he knew anything about the Chauvin/Floyd case, he said no, according to FOX 9 reporter Paul Blume.

“Judge Cahill asked Juror #52, whether he heard anything about the #GeorgeFloyd civil case,” Blume reported at the time. “He says, no. He explained hearing some basic info about trial dates, etc from the news in recent months, but nothing that would keep him from serving as impartial juror. #ChauvinTrial.”

I wonder if this guy could be prosecuted for perjury.

If this isn’t grounds for a mistrial I don’t know what is. Furthermore this verdict is tainted and if the verdict is allowed to stand then our judicial system is no better than kangaroo courts all over the world.

No. But it is grounds to over turn a conviction.
Jurors lying during Voir Dire
Quote:Jury selection is a controversial process. Although prospective jurors are presumed to tell the truth, we know that some jurors do not tell the truth. Some jurors may give false or misleading answers inadvertently, perhaps because they do not understand the questions or because of a failure of memory. But some jurors are clearly dishonest, and deliberately lie to conceal biases, prejudices, and prejudgments, often in order to be selected to sit on the jury. A juror’s deliberate lies can imperil a defendant’s right to a fair trial and if found out, is a basis to overturn a defendant’s conviction.

RE: Derek Chauvin Trial (BREAKING: Verdict Reached)
Quote:Derek Chauvin’s legal team has filed a motion requesting a new trial on multiple grounds, including jury misconduct.

In the filing, Chauvin’s legal team says the former Minneapolis police officer should receive a new trial in the “interests of justice; abuse of discretion that deprived the Defendant of a fair trial; prosecutorial and jury misconduct; errors of law at trial; and a verdict that is contrary to law.”

“The jury committed misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and/or failed to adhere to instructions during deliberations, in violation of Mr. Chauvin’s constitutional rights to due process and a fair trial,” alleged Chauvin’s attorney Eric Nelson.

Nelson also alleges that the court failed to sequester the jury during the trial, which caused the jurors “to prejudicial publicity regarding the trial during the proceedings, as well as jury intimidation and potential fear of retribution among jurors.”

One of the jurors admitted that he attended a rally in DC. Photos also have emerged of the jurors wearing a BLM shirt.

RE: Derek Chauvin Trial (BREAKING: Motion For A New Trial)
My question would be with all this overwhelming evidence that there was issues with the jury plus intimidation from BLM, Maxine Waters, and other politicians what’s gonna happen when they deny the motion for a new trial? Will everyone just say “too bad” and move on with our lives or will people finally say enough and do something besides just take it in the rear over and over again. Say what you want but the left is always out protesting and complaining about something while the right does and says nothing.

RE: Derek Chauvin Trial (BREAKING: Motion For A New Trial)
Look, I think Chauvin is absolutely a POS and a bad police officer. Racist? I don't know. A dumb*** that should be held accountable for a decision that led to the death of a human being... yes.

However, anyone arguing that Brandon Mitchell was an unbiased juror is an absolute idiot. Likewise, he should also be held liable for his action. Perjury is serious, and he purposefully answered pre-trial questions by the prosecution/defense falsely. Did he do so falsely with the intent to be on the jury? I don't know, but with all this evidence it seems likely.

What a mess. The BLM organization and it's idealism really only has itself to blame here.

It's no different than a lynching.

A man's fate is decided at the hands of a racist, angry, prejudiced mob instead of by the proper application of the law.

I agree, the talking legal heads on the TV say that an appeal is not likely to be successful. I guess I'm missing something because this looks like a big time problem to say he got a fair trial.

Chauvin isn't a good guy. He deserves to be punished, based on everything I've seen, heard, and read about the trial.

He didn't get anything CLOSE to a fair trial.
