President Trump on Tuesday signed an order directing the U.S. Census Bureau not to count illegal immigrants when awarding seats in the House of Representatives based on each state’s population.

The directive requires Commerce Secretary Wilbur Ross to provide “information permitting the President, to the extent practicable” to exclude immigrants without legal status from the population count used to divide up House seats. States use the census count, conducted every 10 years, to redraw congressional districts based on how their populations have shifted.

Illegal immigrants will be counted. The question is whether they will be considered in allocating seats in the House of Representatives.

This will go to the Supreme Court. Don't think Roberts will allow it given his ruling in contrast to the law about the illegal immigrant question. So that's 5 no votes. The other 4 will evaluate the law and so its hard to know how they would vote.

In Texas in 2018, there were 117,000 votes in the heavily Hispanic east Houston district. There were 139,000 votes in one of the South Texas districts. There were 350,000 votes in the district north of San Antonio. Illegal immigrants are now included in allocating House districts. No state has tried to eliminate them in setting up districts so it hasn't been tested.

There was a case a couple of years ago where someone tried to force a state to exclude them. Court ruled that the state could include them, not that they HAD to include them.

yes, and California has benefited by about 6 House seats because of it. Other states too I'm sure, but not nearly as many as California. Conversely, that also means some states are under-represented in the House, mainly smaller 'red' states.

I don't even know why this is controversial.

I know why some will raise a fit, but are we really to apportion seats in the "People's House" based in part on people that shouldn't be here? Pretty sure that was not the intent. Likely also the twisted way the left will argue it: "People v. Citizen", but that's a pretty loosey-goosey way to read that with all else considered.

If you bothered to read what I wrote you would have known I understood that. That doesn't change the fact that the title is a lie spread by the MSM and Never-Trumpers like the National Review to detract from the real issue on which the President has a fair argument.

Jim.... His contention is that the headline is a lie/misleading. I do not believe he claimed you wrote it.

Clearly there is a difference between them not being counted at all... which under-estimates the need for services, hospitals, fire etc etc etc... and them not being counted for representation in Congress.

I don't see why this is so controversial. If a select few states don't follow federal guidelines, it doesn't effect the other states who do and doesn't dissolve their political power for national elections.
