The 3-judge panel that is giving the 10-days’ notice is comprised of 2 GOP-appointees (1 Bush, 1 Trump) and 1 Dem-appointee (Obama). That’s kind of remarkable, given that the 11 judges currently on the DC Appellate court are 7D and 4R. I wonder if some of the Dem. judges recused themselves?

Anyway, the abrupt tone of the Order suggests they are not amused. Ten days to respond is not much time, although obviously the judge’s staff and outside friends like Gleeson will do the heavy lifting. Declining to refer to Sullivan by name (simply, “the district judge”), just wow. That is borderline rude. And providing a little courtesy citation to the obvious judicial precedents is almost like saying “Here’s your homework. And this better be good.”

Sullivan’s behavior is arguably in violation of Canons 1-4 of the Model Code of Judicial Conduct...btw, there are only 4.

I truly hope he does, because if he's done any good while on the bench, that's now going to be thrown into question and all those cases could be reviewed or reversed.

Behave ridiculously and you should be treated as ridiculous. Judge Sullivan is getting the treatment he deserves in this case. In fact, I’d argue he is probably being treated too kindly. I’d like to see a more public reprimand of some sort. Most people won’t see this decision as the slap down it actually is.

Even if he's disgraced, disbarred, and ran out of town on a rail, CNN/MSNBC will hire him as a legal analyst.

As I said before, if I were an appellate judge reviewing this case, I'd direct Judge Sullvan to recuse himself from future cases until he completes remedial courses in constitutional law, criminal procedure, and ethics.

Appeals courts don’t hear cases like this. This case is so far out there that this will be the first time an appeals court will act on an open case that hasn’t been decided. Let that sink in. The first time ever. The Democrats are so far out of line that an appeals court is getting involved in a regular court case.

IMO, there's a good reason the appellate court cited its own 2016 Fokker precedent in its order for Sullivan to respond. That case was also a 48(a) dismissal like in Flynn's case and says clearly that ONLY the DOJ can decide whether to dismiss a case or not. The court has NO authority to question it. In short, Sullivan is Fokkered.

The one Democrat appointee will vote 'no' and the two Republican appointees will vote 'yes'... so that the left can claim it is 'partisan'... but the remaining Democrats don't have to say anything so they don't have to 'defend' the indefensible, nor do they have to do what they know they need to do and
throw their peer under the bus

There should just be 11 independent Jurists instead of Democrat and Republican. Once they are appointed it shouldn't matter. That is why a so-called "Court of Law" is the LAST place one wants to find out who is right and who is wrong.

Hambone, you could be right, but I think this is something that goes beyond politics. What Sullivan is doing is a judicial outrage. And if a D-judge is allowed to get away with it this time, who’s to say that a R-judge won’t try it next time? That’s the danger with allowing these sorts of things to continue. Especially because it’s in DC where so many politically-sensitive cases are heard.

Writes of mandamus are so exceptionally rare it takes a hot mess of a judge to actually have one be acted upon. It’s the type of thing law school grads have to remember for the bar exam and then never see for their career.

Sullivan is an abject embarrassment. He’s a political operative.

What I see is that they are 'so not amused' that they want Sullivan to respond within 10 days. If you recall, Sullivan's appointment of judge Gleeson to essentially act as a prosecutor and that judge saying that amicus briefs are to be in by June 10 (?), the Appellate Court is cutting this off at the knees. They are essentially saying that "this nonsense will stop NOW, before it even gets underway."

Bravo.

Good catch, MHB. I missed that detail I agree it’s significant.

I think Gleeson himself had suggested Wednesday/10th June as a deadline for completing his own work, but I’m not sure if Sullivan had formally/officially agreed to that. Either way: by setting it’s own deadline for Sullivan’s response on Monday/01st June, the Appellate Court is sending a loud-and-clear signal — about as subtle as a train-whistle at a busy intersection — that it is not going to let this process drag out.
