Nope.... I'm not sure how you would draw that conclusion.

Settlement has been reached in principle or he wouldn't have withdrawn. Just waiting on all parties and lawyers to accept the final resolution. There'd be no reason to file Non-Suit otherwise.

I will explain with at least 99% accuracy exactly what is happening.

1. The NCAA tells us that they won't settle with a pending lawsuit
2. There IS a settlement and it is GREAT for us, anywhere between 2-4 games max
3. The legal team wouldn't settle for anything more than 4 games
4. We declare that Wiseman will sit so the NCAA can say that they "won" and that they are not being sued
5. The legal team and Wiseman and Penny know the terms already, but the settlement might not be announced right away
6. The fans might be left twisting in the wind, but the settlement is already known. The purpose is for the NCAA to not look like they caved in right away
7. The legal team tells the NCAA, we obviously don't trust you and reserve the right to sue you if you screw us again with any bull****
8. The terms of the settlement are legally binding, the NCAA cannot reopen the case under any circumstances

I just do not see that happening. It will all be agreed to up front and both parties will agree to accept the terms with neither party being able to revisit or appeal the issue.
