The illegal alien lived in a region of Iowa that was surrounded by sanctuary cities, as Breitbart News noted, and worked on a dairy farm using a stolen ID and Social Security card after allegedly crossing the U.S.-Mexico border as a child.

A 29-page motion obtained by the Des Moines Register and filed by Bahena Rivera’s defense attorneys, Chad and Jennifer Frese, claims that the illegal alien had his constitutional rights violated when local Iowa police took him in for questioning and did not make clear that he could have contacted the Mexican consulate before speaking to law enforcement.

“Providing this information to Bahena — a confused, exhausted and vulnerable Mexican national was seeking trustworthy help — would have triggered an invocation of consular notification and a decision to await the consulate’s assistance before making any other statements,” the defense attorneys wrote in the motion.

Last year, more than 200 American taxpayers sent letters to the court saying that illegal aliens living in the U.S. do not have constitutional rights and therefore should not be awarded taxpayer money to pay for their defense.

Among other accusations, the defense attorneys said police did not read Bahena Rivera his Miranda Rights until hours into a 12-hour interview — a violation of his constitutional rights that they claim should nullify his alleged murder confession.

Bahena Rivera has “very limited Mexican education” and “wholly unfamiliar with the U.S. criminal justice system,” his attorneys wrote.

Bahena Rivera’s attorneys have sought for months to suppress his alleged murder confession and have it thrown out of the case before the trial begins on November 12.

Already, Bahena Rivera successfully got his trial date pushed back and moved his trial to a less white, more Hispanic-populated county in the state.

According to prosecutors, Bahena Rivera was the last person who saw Tibbetts jogging on the evening of July 18 in Brooklyn, Iowa, security camera footage reveals. That is the night Tibbetts went missing.

The illegal alien told police that Tibbetts was jogging when he saw her, according to prosecutors. That is when he said he approached Tibbetts and started talking to her. After Tibbetts told Bahena Rivera that she would call the police if he did not stop following her, the illegal alien allegedly chased her and says he “blacked out” after this.

Police believe Bahena Rivera stabbed Tibbetts to death, then drove to a cornfield where prosecutors say he placed corn stalks over her to hide her body. The illegal alien has been held on a $5 million bond.

Really? How about HER constitutional rights? He violated her life, liberty and pursuit of happiness. It's BS and as far as I've been told by our lawyers here they are not entitled to any constitutional rights as he's an illegal and not even a Resident Alien.

Think I've mentioned it here before, my wife had a friend get killed early on a Sunday morning.. She was a charge nurse at the hospital my wife worked at, left the hospital at 6 AM after working all night and was killed 10 minutes later in a head on collision. The driver of the other vehicle was 19, survived with barely a scratch (he was in a full sized pick up and she was in a Honda Civic), and we're unsure how but he had a BAC that was over the limit granted with him being a minor anything is over the limit (theory is he was out drinking and got up the next morning and it wasn't out of his system, police said he and the inside of his truck smelled of alcohol, eyewitnesses said that there were beer cans all over the highway and all in the cab of the truck). Anyways he's arrested for driving under the influence and wreckless murder...

Fast forward to being arraigned and such, his court appointed lawyer tried to have him tried as a juvenile. Pleaded with the judge.. The judge took it under advisement.. If tried as a juvenile, it's basically a slap on the wrist and his record gets expunged... Judge comes back and states after a lenghty review that the kid had made adult decisions that ended with adult consequences, he would be tried as an adult, the penalty could land him up to 20 years in prison. The lawyer then played his hand, the kid is an illegal alien, been here since he was 5 and he couldn't possibly serve any type of sentence for his crimes, he needed to be handed over to ICE and deported. Judge called for a recess.. Came back in let them know he had spoken to ICE and they would allow the kid to stand trial and serve whatever sentence he was given then on the day of his release he would be deported.. The judge also told the lawyer that what he did was unethical holding that information from the court and he would start the proceedings of having him disbarred.

ETA: The kid was found guilty, he'll be sentenced tomorrow. He was found guilty of reckless murder (sentence 1-99 years by Alabama law), driving without a license, and possession of alcohol by a minor.

But hey they're seeking asylum.

I think it's a process... So I'm sure the lawyer is under investigation.. But he couldn't afford a lawyer, but we paid for him one...
