Seems someone assumed they had rights to all of someone related to the UofM and that someone's representative does not agree.
Am I missing something?

Yes. To say Learfield and UofM are not connected is akin to saying that Claire and Frank Underwood were not connected. But Gaston is a self serving prick with strong ties to his Alma mater the University of Maryland.

I don’t know what happened but isn’t it fair to assume that the higher ups (Perhaps even Rudd) tried to convince this outfit to back off from Penny and they refused to do as Penny wanted? Also raises the question of whether Bowen was involved and was a conflict of interest.

Wonder what the signed agreement between the parties says. Have to start there. If no signed agreement the what the law firm is contending creates an agreement. The article really doesn't address any of that.

If you do some research into LEARFIELD/IMG you will find out a lot. The DOJ just got on them due to LEARFIELD claiming they had exclusive rights. This action by the DOJ just took place in February of this year.

Here is what the DOJ said.

Justice Department Requires College Multimedia Rights Provider to Refrain from Unlawful Agreements Not to Compete
The Department of Justice announced today that it had reached a settlement with Learfield IMG College to resolve a Department lawsuit alleging that it engaged in unlawful agreements not to compete for multimedia rights contracts for universities’ athletic programs.

The Justice Department’s Antitrust Division filed a civil antitrust lawsuit today in the U.S. District Court for the District of Columbia to challenge unlawful agreements not to compete. At the same time, the Department filed a proposed settlement that, if approved by the court, would resolve the lawsuit’s alleged competitive harm.

“The illegal agreements not to compete allowed Learfield IMG College to benefit at the expense of the nation’s universities, students, and fans,” said Assistant Attorney General Makan Delrahim of the Justice Department’s Antitrust Division. “Public and private universities rely on competition among multimedia rights providers to provide critical resources to athletic programs, but these agreements lessened that competition and thereby harmed the universities and, ultimately, American students and taxpayers.”

The proposed settlement prohibits agreements not to bid, or to submit joint bids, between Learfield IMG College and any of its competitors in multimedia rights management. The Department has determined that prohibiting this conduct would resolve the competition concerns raised as a result of Learfield IMG College’s actions. The proposed settlement further requires Learfield IMG College to adopt rigorous antitrust compliance and reporting measures to prevent similar anticompetitive conduct in the future. Learfield IMG College has cooperated with the Department’s investigation and will continue to do so as it adopts these measures.

Learfield IMG College, a subsidiary of A-L Tier I LLC, is headquartered in Plano, Texas. Learfield IMG College provides a variety of services to universities, including multimedia rights management, trademark licensing, and ticketing.

Can you blame him? It you look at precident....with Penny and NIKE type deals, those contracts were between Penny and those companies. I have a hard time understanding why Penny would relinquish those rights to another party like Learfield and this law firm.. I am sure Penny's contract with the U of M was very specific and any such terms would have to be approved by Penny's attorney before signing the employment contract with the U of M. Why would he give up his intellectual property rights to Learfield that then sells them to a law firm outside of the U of M that Penny is not able to negotiate with for an IP license?

agreed. the contract clearly states that his image and likeness is to be used only for the agreed upon terms. nowhere in it does it state they can sell his image or likeness for anything else.

I think the wording could have been "suiing Tiger Sports Properties (Learfield/IMG) the non exclusive multimedia rights holder of the...."

The very low $ values as they would relate to Penny are telling. Poor job of reporting IMO.
