14 NM counties vote to become 'Second Amendment Sanctuary Counties'
Quote:QUAY COUNTY, N.M. (KRQE) - A county in eastern New Mexico has declared itself a "Second Amendment Sanctuary County."

The Quay County Commission voted unanimously in favor of the resolution. They say it's in response to several gun-control bills pending in state legislature.

The New Mexico Sheriff's Association has come forward saying the laws are ill-conceived, unenforceable and punish law abiding citizens.

The House Republicans issued a statement Wednesday saying they are proud of Quay County for standing up for the rights of New Mexicans.

This is where the rubber meets the road. Pass all the gun bills you want, you are going to have a hard time finding sufficient numbers of LEO or military personnel willing to disarm their fellow citizens. IMO more will defect to the other side than would go along with any gun confiscation scheme.

RE: NM county votes to become a 'Second Amendment Sanctuary County'
Quote:Two more rural counties in New Mexico have passed resolutions saying they will not require their sheriffs to enforce a series of gun-control proposals that have gone before state lawmakers.

Commissioners in San Juan County in the state’s northwest corner and in Eddy County in the southeast have adopted “Second Amendment Sanctuary County” resolutions Tuesday.

Sheriffs in Curry, Quay, Socorro and Union counties recently presented similar resolutions that commissioners have adopted in response to the proposed state legislation.

The proposals include a bill that would expand requirements for background checks on gun sales. Another measure would allow for courts to order people who are deemed to be a threat to themselves or others to temporarily surrender their guns to law enforcement.

The New Mexico Sheriffs’ Association plans to file a lawsuit in July if the bills become law, San Juan County Sheriff Shane Ferrari said. The courts will then decide if the measures are constitutional, which Ferrari said he believes they are not.

“The main purpose of this is to get Santa Fe to wake up and listen to the rest of the state, not just the Rio Grande corridor,” Ferrari said of the resolution.

San Juan County Commissioner GloJean Todacheene, a Democrat, had the lone vote against the resolution. She said the legislation is still making its way through the state Legislature, so she needed more time to study the proposals.

The commission passed the resolution with cheers erupting from the crowd at the commission chambers in Aztec, where a 21-year-old gunman killed two students before killing himself at the city’s high school in December 2017.

I don't support cities declining to enforce the laws of this country, but I DO think this is a good example of how wrong immigration sanctuary cities are

RE: 12 NM counties vote to become 'Second Amendment Sanctuary Counties'
Quote:BERNALILLO – Sandoval County is now a Second Amendment sanctuary county.

The Sandoval County Commission voted 4-1 to make the county the 12th in the state to take that designation, in protest of gun-control bills in the New Mexico Legislature, at the meeting Thursday night in the county administration building. The sanctuary resolution says the commission supports the sheriff in any decisions to not enforce unconstitutional laws and to not use any county resources to enforce laws that infringe on the right to bear arms.

But they are enforcing the laws of this country, i.e., the US Constitution.

That's not the point. If it's unconstitutional, the laws won't stand... but that's not my (or your or these voter's) call

The point is that this is the direct counter to sanctuary cities who decide NOT to enforce laws. If the left thinks this is wrong, then they are admitting that immigration sanctuary is also wrong, or they are hypocrites.

If you argue the constitutionality, you're just giving them an out.

Immigration law is obviously Constitutional, but they've chosen not to obey. If they argue that thes gun laws are constitutional, then why can't cities similarly choose not to obey?

RE: 14 NM counties vote to become 'Second Amendment Sanctuary Counties'
Now up to 14 counties and 1 municipality passing resolutions as 2A Sanctuaries.

Quote:As gun laws make their way through the state Legislature, 14 county commissions around the state – including those from Sandoval and Valencia counties – have passed resolutions declaring their county to be a “Second Amendment sanctuary county.”

The sanctuary resolution says a commission supports its sheriff in any decisions not to enforce unconstitutional laws and not to use any county resources to enforce laws that infringe on the right to bear arms.

It is likely to be passed in even more counties at meetings in the coming weeks.

But even though its sheriff has thrown his support behind the movement, Bernalillo County doesn’t appear likely to be one of them.

“I will be very surprised if any commissioner proposes that type of resolution for Bernalillo County,” said Commission Chair Maggie Hart Stebbins. “At one point or another I believe all of us have expressed support for common-sense gun safety legislation that is being considered in Santa Fe. I can speak only for myself but I believe the commissioners all support what’s being proposed in Santa Fe.”

Hart Stebbins commented on the resolution after Bernalillo County Sheriff Manuel Gonzales issued a statement Friday saying he “confidently supports” a Second Amendment sanctuary county.

Ultimately the decision will be made by the County Commission, he said.

Among the gun safety legislation that has been introduced is a bill that would expand requirements for background checks on private gun sales. Another would prohibit an individual convicted of battery on a household member – among other crimes – from having a firearm. And yet another would allow family members or police to seek court orders to temporarily take guns away from an individual they believe to be an immediate threat.

“As your sheriff, I believe there are enough laws on the books to effectively deal with the unlawful possession and use of firearms by any kind of perpetrator,” Gonzales wrote. “I will back any legislation that mandates a consistent, swift and appropriate penalty for any illegal possession or use of a gun. I do not support, aid nor condone any effort or legislation that will infringe upon the right of law-abiding citizens to bear arms.”

Gonzales was not one of the 29 sheriffs who initially joined opposition to the firearm legislation, said Cibola County Sheriff Tony Mace, the chairman of the New Mexico Sheriffs’ Association.

“When you look at the 29 sheriffs that oppose it, they’re all rural New Mexico sheriffs,” Mace said. “The ones that stayed on the fence were Santa Fe County, which is heavily populated … Doña Ana County, same thing, and Bernalillo County, which is the heaviest populated county in the whole state.”

In response to questions about what made Gonzales join the opposition, BCSO spokeswoman Felicia Maggard wrote, “As the sheriff of the most populated county in the state, Sheriff Gonzales has taken great care to make informed and educated decisions on behalf of the citizens of Bernalillo County.”

Valencia County

In front of an audience of nearly 150 residents Wednesday night, Valencia County commissioners approved the nonbinding resolution declaring the county a Second Amendment “sanctuary county.”

Dozens of residents offered their opinions, with the majority favoring sanctuary status. It was sponsored by Republican Commissioner David Hyder.

The resolution, like many others approved across the state in recent weeks, supports the recently elected sheriff, Denise Vigil, a Democrat, in her decision not to enforce laws she deems unconstitutional, said Valencia County Attorney Adren Nance.

“This is a general policy statement, not a law,” Nance said.

The proposed legislation under consideration at the Roundhouse is a threat to and in direct conflict with the Second Amendment of the U.S. Constitution, said lifelong Valencia County resident Ron Romero.

“I doubt any reasonable person would disagree there is too much gun violence. These new laws only serve to temporarily satisfy a group of individuals who think the solution is pass another law,” Romero said.

He called the proposed bills “part of a larger effort to reduce and erode the Second Amendment.”
