Lin Wood, an Atlanta-based lawyer, told LifeSite yesterday that Phillips’ “lies and false accusations” against Sandmann and the other Covington students are “well documented.”

He also said they would be filing the first round of lawsuits "within two weeks." Todd V. McMurtry, a Ft. Mitchell, Ky attorney, is also representing Sandmann and his parents. Doug Schloemer, a Ft. Mitchell, Ky attorney, represents a number of other students and Robert Barnes, a California attorney, is also representing families and students of Covington High School.

The legal action by Sandmann’s attorneys is ramping up after notices demanding preservation of evidence for possible slander litigation were recently sent out to more than 50 media, dioceses, and celebrities.

Wood told LifeSite that the list of recipients of the notices “continues to grow in number” and that the legal team is “in the process of sending formal written retraction demands in conformity with statutes in states in which litigation may be filed.” They expect to advance to the next stage and “file the first round of civil lawsuits within the next two weeks.”

What type of money can they collect? How can you estimate damages on a HS kid who is not gaining or losing any business/professional value as a result of this?

I buy that this was defamation, but unless the lawyer is doing this pro bono then I don't see the juice.

Against news organizations... who knows. They've effectively harmed his reputation for his entire life. That's something he will always have following him. A good lawyer will talk focus on that point. He's not even an adult and Major Media Companies attacked him. I assume most will settle out of court and try to avoid a judgement against them.

Because that will set a VERY public precedent, that Im sure they'd rather avoid.

It only makes the SCOTUS if a party in this case requests there to be legal review of the proceedings and there are no appeals as a matter of right.

SCOTUS may also hasten this process if this becomes a manner of constitutional law. I'm not sure what is exactly "new" in this situation that isn't clearly explained on the books as-is.

The handling of the raw material was not done in the highest of journalistic standards, so perhaps consideration of the line between "Freedom of Press" and "slander and libel" may be necessary now that we are in 2019.

The area of the country Sandman lives in (Greater Cincinnati) and where his legal action will move forward is very much in Sandman's corner. We are appalled by what happened to him and his Cov Cath classmates. His legal action will not be thrown out.

Sandman can sue for libel. Whether he wins would be up to a judge/jury.

Key evidence would be the extended video and the interpretation by the judge/jury as to which party is telling the truth or if there is room for both parties' interpretations being the truth as they see it.

Phillips has lied before and been caught in falsehoods. He also has a proven history as an instigator agitator. Guarantee both past lies and his past attempts to agitate will be presented as evidence towards his credibility.

He said the boys “surrounded him” and that he felt threatened. Further, it was staged by he and his “videographers”. One is clearly heard saying “ Ok, we got what we wanted”, or ok we got plenty, something along those lines.

He was clearly trying to provoke them, so he once again took “ point”.

That and he’s a lying dicktard, these are KIDS. Messy his life up a bit, maybe next time he sees the error of his ways.
