Intestate Will
I know we have a couple of lawyers on here. We have traced back heritage to show my in-laws are the rightful heirs to a deed of mineral rights. The energy company is demanding we have proof the person who held the deed died without a will. There is no record of her death at the county she died in. The records were kept in Columbus Ohio somewhere. We ordered her death and birth certificates online. Can I get an intestate will online. The energy company is demanding this before they cut any royalties. My in-laws went to their family attorney and he wasn’t able to help. I’m sure she died without a will. We just need to prove it. Any help would be appreciated. PM me if anyone has any idea on how to go about this. I’m hoping it’s something I can do online.

I just did some research. I'm going to call the energy company. How do you prove a negative? An intestate will means they died without a will. You can't prove something that is not there. Intestate succession laws shows the rightful heirs. We have that. uggghhhhhhh

Let me see if I can get a hold of some of the attorneys at my previous firm. We did Oil and Gas. I know one way, is looking for an obituary.

Update.

Informed in-laws that they need to go to the county the heir died in. Go to the probate court to see if an estate was ever opened. If so there is a will. If not they should be able to give an affidavit saying the departed died in intestate and that should be the end of that. We shall see. Thank-you for your help UTSA......
