Must have some attention seeking attorney doing his case. Sounds like something that gets thrown out quickly. Just because the DOJ under Obama didn't do their job doesn't mean he has a case.

Honest question: Is “selective prosecution” really a valid cause-of-action in a civil claim against the feds?

Dunno. But from here forward, if I was crossways with the gubmint for mishandling classified info, I'd sure expect my attorney to use the Cankles-defense.

I think that’s a good point to raise with the jury if you’re representing the defendant in a criminal trial. Less sure of the relevance if you’re the plaintiff in a civil action.

I don't know why he would have a case but I do hope he can make one
