Steward agrees to settlement deal
A little over a month before the wrongful death suit was to start in NY Tony Stewart has agreed to a settlement deal with the family of Kevin Ward Jr.

No matter which side you come down on in this deal Stewart would have had to be the biggest fool in the world not to settle this out of court.

With NY being a share liability state and his history of anger management issue, he most likely would have lost his shirt if this went to trial and end up costing him more than settlement in legal fees alone.

I think he's liable as hell. Not criminally responsible but definitely should be paying out.

He made the tail swing around to hit the guy or at least scare him.

2 people with bad tempers met up and something bad happened. If it hadn't been Tony Stewart involved in the original wreck you have to wonder if Ward would have made the wrong decision to get out of the car. Many people have climbed out of the safety of their car to confront another driver and nothing bad happened. This time it did.

There is no doubt in my mind he purposefully swung his tail. I dont think he meant to hit him, just throw some dirt on him. But bottom line, yeah he should be paying.

No one in their right mind thinks that he intentionally went out to hurt the guy. That would be over the top even for someone with an anger issue like Stewart. But he was clearly trying to intimidate the kid and things went wrong.

Not that there aren't times when anger does over come common sense. Seen a few incidents locally where anger made people do some stupid things.
