Tubby shouldn't get his full payout. He had his lawyer to say that Tubby wasn't responsible for putting butts in the seats. A big part of his contract was public relations.

I presume he was referring to himself and his coaching staff. I honestly don't know what else the players could have done.They played as hard, consistently through the season, as any Tiger team I can remember.

If Tubby is willing to take the buyout, then Tubby should be willing to take the blame.

I think he was referring to the clause that missing post season play would somehow reduce Tubby's final amount due.

I don't even know how that would be enforceable in practice.

Says he can't be fired w/out cause while the team is still playing. There's probably a section enumerating what's for cause. Pastner's contract had things like gross violations of NCAArules. Violation of University, BOR, or state rules that apply to him as an employee of the University. Commission of a felony. Disappearing from the job. Becoming disabled such that he'd be completely unable to perform his duties.

There's was also a whole process the University had to go through, involving notice and an internal hearing in front of a panel chosen in part by Pastner.

Smith's contract probably has very similar provisions.

Even after (apparently) lying about death threats against him and his players, Florida football coach McElwain still got $7.5M of his $12.9M buyout. I suspect Tubby's lawyer will keep him from doing anything to jeopardize the full buyout.

A question for some of you legal beagles on here.

Tubby's contract provided for him to be paid X amount ($1.1 million?) for getting out there and promoting the team in media...etc etc like Calipari once did.
As he didn't seem to be doing much of that...would that in itself not constitute a reason for not giving him a full payout?

We paid you to sell our team to fans/recruits.
As you did not go about that in a guidelines set forth by the University...you don't get paid that amount of money for the job you were hired to do.

I'd appreciate a rational response..contracts are not my forte (I'm more of a computer guy)

Didn't he have a clause where if he lost to a team 3 times in one season he could be fired without cause, i.e. the Cincinnati clause?
