You can't claim a breach in performance just for being really bad at your job. This is squarely on the admin and is really sad for ECU.

You can claim breach when being ridiculously bad is a breach of the contract. That's called freedom of contract and while there are restraints in NC, none apply here. I highlighted the pertinent clauses. Put it in the hands of a jury of peers (local Greenville/ECU fans) after arguments both ways and see where the chips fall.

People talking about the cost of litigation need to remember that such a pecuniary burden would be much more detrimental on Compher himself as an individual over an entire institution. That's why Compher would settle. No one is gonna feel sorry for that AH. Potential AD candidates would know he sucks and would welcome the opportunity to turn around a program in such bad shape (only way to go is up), with such a loyal fan base, in a fairly visible conference.

Notwithstanding, lawyers exploiting technicalities at times, the law simply does not reward jerks. It really comes down to common sense. The guy is not doing his job up to standards so he can be fired per the contract. Sometimes the pessimism and skepticism is strong here on this board. It is perhaps warranted in this case but that doesn't mean that there aren't options at the university's disposal.

Things are going from bad to worse. At this point we can try it and even if we lost in court it would make Compher spend some money and he'd be forced to defend himself. That alone would be worth it for me & I would donate my hard earned cash towards such a fund. Based on the 'decisions' we are making and the direction we are going in, I think this is far from frivolous. In fact, I'd bet money that we would come out better as a University if we did go this route now. But we need to clean house from the top to bottom. There's no doubt about that.

You may be right and I admire you as a long time rational and intelligent poster on this board but that doesn't mean that this isn't a conversation worth having. If we just accept the status quo then nothing will happen. Granted this is just a message board but it is a medium where discourse is facilitated. When people type in key words into google this thread will come up and at least make people think.

IMO, ECU has an affirmative duty to mitigate its damages and I submit that this is the best route for the points that I previously outlined. Furthermore, if a party acts in bad faith or with reckless disregard then it is in the courts discretion to award ECU the cost of legal fees as well. This is just another bargaining chip to use against Compher to settle for pennies on the dollar.

At first some of you at least tried to challenge my assertions on the merits. I urge you to do that but to say it's a cause not worth fighting for because it 'isn't going to happen' isn't a good reason if you ask me. I agree that our claim would have more merit if we completely cleaned house but either way it is our best option under these specific circumstances. Please look back at each of my posts/responses and let me know a little bit more why you are skeptical of such a scenario. I sincerely believe this is a viable and possibly even necessary move for our beloved university at this point.

Everyday he is employed is counterproductive. That's the truth. Now this won't get rid of him, but any ideas that could work are more productive than sitting back and letting him ruin what little there is left to ruin of ECU athletics.

If the trial is in Greenville the dude is toast.

Firing Ruff was literally the dumbest decision that man could have made. One of the biggest plagues of being outside of the P5 is the lack of stability. You get some momentum going and then your coach leaves. That wasn't going to happen at ECU under Ruff.

I agree & what do we have to lose at this point? Regardless, he needs to be fired so we might as well put him on the spot to defend his actions and at least recoup some of that awful buyout?

This is the guy coach Mo hand picked a couple years ago. Watching Lincoln Riley assume HC duties while continuing to call plays last night for OU made me question why coach Mo doesn't do the same. Then I remembered Mo had been relieved of those duties while at Duke and for some reason JC thought he was the right guy for the job and in that same vein Chancellor Staton thought JC was 5-year extension worthy.

Mo may well not have been the right guy (time will tell) but those of us that have watched from the stands know Ruff was not the guy either after Reilly left for Oklahoma. Ruff is great human being and a guy you love to have in your program as a position coach, motivator and recruiter. He is however a horrible X's and O's head coach. His defenses at TT were mediocre....His defenses at ECU were God awful. Everyone loves to point out that his team put 70 on UNC. They forget that UNC scored 41 that game...on our field. Navy is still scoring TDs on us now...He never had a damn clue what to do with Navy. When the O left for Oklahoma...Ruff had no clue what to do after that. That is what cost him his job. 07-coffee3

Ruff's faults listed in this thread are true. I was at the last game he coached against Cindy and the clock management was awful. Lost on a field goal as time expired.
However, it's not like he never won a game. He should have gotten 1 more year and if he didn't work out there would have been time to find a replacement. Compher fired him with no clue for a successor.
ECU football came into the AAC from a good position. 2 recent conference championships, a 10 win season, the first G5* team in the playoff poll.
Compher, the BOT, idiot big money boosters are destroying ECU football and athletics. The mechanism is now in place for this to continue.

We are, but that has nothing to do with the unmitigated disaster it appears Coach Mo is. Has nothing to do with the horrible thought process that lead Compher to fire a coach that while had plenty of faults put a competitive product on the field and won OOC games against "name" opponents. He took a huge swing and missed. I didn't have a problem with it at the time but also fully understood it was a huge risk that could big time blow up in our faces. Well it has in the worst possible way, but then has been compounded by leadership at the very top extending Compher for no rational reason prior to the start of the season. Without that extension my thought process right now would be Mo's gonna get to play out the season and if it keeps going like this we'll clean house and start over. Now even if we go 0-12 I don't know if ECU can afford to clean house. You are looking at well over 3 million in buyouts to fire Mo and Compher and then whatever you would have to spend on their replacements. That's probably not feasible unless ECU just decides to shelve the stadium expansion.
