More Stadium Delays?
Alan Collins is reporting that a group of citizens is appealing the Alabama Supreme Court ruling validating Jeffco's sales tax refinance to the Supreme Court. I'm not a legal scholar, but I would think that would halt Jeffco from proceeding with its refinance until the Supreme Court either hears or tosses out the appeal.

Hey, might as well enjoy lesion field while we're here. We'll get our own PCS by the time the BJCC announces a new stadium. I'm hoping we get 2 or 3 good strong win seasons so we can push for an OCS.

Part of the appeal is that the debt refinancing involved Oliver Robinson and Balch & Bingham...

what? this doesn't make any sense

they're appealing to the us supreme court? pretty sure they can't appeal a state law ruling. EDIT: to clarify, the US Supreme Court's jurisdiction covers federal, not state law and if it was a federal law in question this would've been in federal courts and never made it to the Alabama Supreme Court in the first place

I thought the same thing. The only thing I can think of is that they are appealing on a different point of law as a hail mary. The court may refuse to even hear the argument.

Unless they are challenging a federal law or claiming that the state law is unconstitutional under the federal constitution, the supreme court isn't going to hear it. and, they definitely aren't going to hear it without it coming up through the lower federal courts first. this is just some typical john rogers style bs

Any American citizen can file an appeal to the federal court system over any state action. To be successful in a federal court action however, they must demonstrate an existing federal issue (ie. the rights of a citizen have been abridged).

You often hear the complaint that "the court threw out the verdict on a technicality". This is true BECAUSE the ONLY grounds for an appeal are some technicality (a legal "short cut") that was used inappropriately by one side or the other. One cannot appeal the verdict just because you disagree with it. The appeal must demonstrate a legal error in procedure - a "technicality".
