I tihnk he is meaning "in addition to CSUB IF it in fact affects them." The pre-existing issue is one WE are supposing here. AFAIK, no attorney here has weighed in on anything.

CBU is private, so not subject to law. However State may try to threaten school aid, almost certainly triggering a lawsuit that would head to the CA Supreme Court and District 9 Court, on the way to the SCOTUS. IMO it's just a matter of time before it goes to the Supreme Court.

It is in the language of the bill. Contracts in force as of 1/1/2017. Sac State has a contract with the WAC.

I have given this some thought. There are two obvious mechanisms around this

1. CA schools make contracts with Texas schools whereby the host pays the visitors travel costs

2. CA school claims donations pay for the travel. This is done by creating a travel "bucket" and placing a certain amount of funds in there from donations, and then drawing from it to pay for travel

Of course the preexisting contract also carries. But I think some accounting tricks like above can get around it.

Note: travel to NMSU could be an issue since you fly to El Paso. This will probably be one of the chipping at the edges sort of rulings that will eventually neuter this policy

I think it is possible for some schools in California to do that, but I don't know if CSUB or schools like it could get that to happen. Michigan somehow got a booster to pay $800,000 for their Italy trip.

I think the contract option is the way around it for G5.

But CSUB does get some donations, and it's non trivial ($1,591,399 in 2015-16 according to USAToday). It would just take all general athletic donations (those not specific or which could be included in travel) and put them in a bucket. When they have to play a Texas school, they would draw travel funds from that bucket.

It's just an accounting trick. Other expenses previously designated to few thousands that travel to Texas absorbed from the donation pile, would be filled with other revenue. Just using a different pile.

It would be insane for CSUB to try and raise money separately for travel. That would open you up to protests and other issues. Far smarter to play the accounting game.

Here is the text of the image that is not working. I wont name the CSUB official since its not a public statement

Just saw your message. It is too early for me to publicly respond on whether or not the ban would prevent us from playing at UTRGV. We are waiting for some clarification and guidance from the CSU system. Just as an FYI, one of the exceptions to the policy is any pre-existing contractual obligations. Our membership in the WAC would likely be deemed a pre-existing contractual obligation, I just do not want to commnent publicly until I have a little more clarity
