Thats why a non-game used jersey made to the same specs can be sold with the name on the back.

That's partially true. Every school has their own policies on how they sell off their game jerseys (if they even sell them to begin with, which not every program does).
The NCAA rule applies to active players (or players with remaining eligibility), which, to your point, is why many of the auctioned jerseys either have no name on the back or a slogan. Once a player graduates or declares for the draft, they're free to do whatever they want with their jersey (assuming they actually get to keep it).
However, since the tatoogate scandal at Ohio State, many schools remove the nameplate entirely when they sell their jerseys (even for a player that's graduated or exhausted their eligibility). Not sure how strict this policy is though, since recent OSU jerseys I've seen have been sold with nameplates again (which I assume are jerseys of graduated players).
My hunch is that NIU didn't auction off the Chi-Town jerseys right away because those have the players' actual names on the back. I only saw #16 jerseys being auctioned, so those might not even have player names themselves; could just be a slogan (or blank) to commemorate the 2016 season, there was no pic for the back of the jersey.
Speaking of which, if anyone happened to have won one of those from the silent auction, I'd be willing to make a very generous trade offer
