That's tough. Sounds like you got fleeced big time. Whether a home is sold as is or not, it shouldn't be allowed to be sold with potential health issues without them being explicitly mentioned in the as is selling agreement. It's horseshit that you can just do some basic touch-up to hide major health issues for a few months while trying to sell a home.

It sounds like a real nightmare. I'm very sorry to hear this is happening to you.
Have you contacted an attorney? The AS-IS issue isn't a killer for recovery.
Unfortunately, inspectors generally suck. Here in Alabama most have $500 limits on recovery in the event they miss something, which they do non-stop.
Best of luck to you and your family!

Unfortunately, any award he gets from a lawsuit would probably take at least a year. Meanwhile, he is living in black mold. I have a 7-year old and an 11 month old at home. I'll donate some on Friday.

It's kinda like the wild-west we are learning out here in Oklahoma. We only moved a few months ago. They don't even require building permits anywhere outside of OKC or Tulsa. We are definitely looking into finding an attorney who might be able to help us, however the whole "as-is" thing may prove to be a problem. Then again, the discloser statement of the home's issues signed by the sellers was severely lacking details and even was contradictory in places. As for the home inspector, he had a "doesn't check for mold" clause, however he missed some more obvious leaks (we found them later). You would think that any good home inspection would at least mention any issues of concern regarding the home, whether he "checked" for them or not. The guy was licensed and we have filed a complaint with this licensing agency. Have not had a response as of yet.

Thank you so much. Yes if we were to win any kind of lawsuit it could take months if not years. For now we are living in a hotel. The mold remediation is taking place this week, but then comes the daunting task of trying to find the money to basically reconstruct the entire interior of the home. We are hoping the mold isn't too widespread, I will be contacting the remediation team later today for an update. Fingers crossed.

Thanks. Yeah I had a really great inspector when I lived in Florida and bought a house, but this one was recommended to us, however I never got the best vibes from him (I showed up at the end of the inspection, couldn't be there because I had to work).
