The republicans need to pull absolutely no punches in obstructing the nomination process. No more of Obama's diversity appointees.

Fat chance. He'll probably appoint his wife.

He doesn't give a crap about being poisonous, he revels in it.

Since they own both houses of congress, it might not even be that difficult.

I was watching abc news and they were saying it would be nearly impossible for the White House to get someone nominated and voted for before the end of Obama's term. But they forgot to say you can't say Obama won't try. If he can't this will throw a whole another twist to the upcoming election. If a dem wins the White House independents will essentially be voting for a liberal majority SCOTUS. There's a whole lot on the line now.

I can't imagine that the President hasn't already decided on a candidate to replace him. Frankly, I think he would have expected to replace Ginsburg by now. The main question would more likely be will the Republicans subvert the process by refusing to consider any nominee. And, if they do, will they risk energizing Democrats to get to the polls in November? If Clinton were elected by a Democratic backlash against an obstructionist Republican Senate, that could cement a liberal majority on the court for many years to come.

Despite what people on both sides of the political spectrum are inclined to believe, most nominees are more moderate in their views than their opponents claim. I would expect this nominee to be a little closer to the political center, but not by much. Obama knows that it would be harder for Conservatives to filibuster against a reasonable candidate.

Republicans concerned about the balance of power on the court shifting away from the conservative majority always have the power to get it back by winning the presidency in November.

It's not right to use a SC nomination to try to get other political favors but Obama might try for a compromise of some type IF he gets some cooperation from the Republicans on some other issues (such as the budget or maybe some type of gun control legislation?). I'm just speculating here, but Obama has some extra power today that he didn't have yesterday, that's for sure.

The first order of business is to keep the remaining 4 Conservatives alive.

I was afraid this would happen.

Lol at this. Obama's appointments have been highly qualified. Unlike Bush, who in case you forgot appointed his personal lawyer and Texas Lotto Commissioner to the Supreme Court who got laughed out of contention.

Yeah, it might stay 4-4 until next year. If the Dems win the White House and Senate as they're favorites to do, we shift the Court for a generation. If it's Bernie, we'll have 9 gay female transgender black Hispanics by the time he leaves and you're gonna like it!

Don't worry all your conservative heads about a liberal or moderate being placed. McConnell already stated that no SCOTUS candidate will get a vote, no matter who they are.

Obama's going to use it as a cudgel. Make a show of it and remind Americans what unreasonable obstructionists the Republicans are.

They shut down the government, now they're shutting down the Supreme Court!

http://www.vox.com/2016/2/13/10987116/sc...-court-tie

Interesting article about what happens in a 4-4 tie. Basically, the decision reverts back to the lower court and the SC generally does not issue an opinion. In some cases, a 4-4 tie would be a Republican win, and in some cases, a Democrat win (read the article for some of the importing pending cases and what would happen in a tie).

But I also believe that Kennedy might swing his vote on a few cases so the Supreme Court would have a majority decision. In other words, keeping it at 8 might not do the Republicans much good anyway.

It's strange how Hillary can be favored but Dems aren't favored to also retake the Senate. If the former happens there are enough vulnerable GOPers downballot to make it very likely the Senate comes too.

Reid and Schumer need to take advantage of that. Threaten to use the nuclear option should they get the Senate back next year IF McConnell stalls now. If McConnell will allow a reasonable, qualified nominee through, agree to not go nuclear.
