EPA money grabbing
This is just one small example of the exorbitant fines that they can levy on you. Good luck defending yourself against these bullies.

There has to be more to this story. There are great historical restrictions on what you can do with your own land when it comes to water, water rights, etc.

There's not.
The farmer got all of the required permits and approvals to build, that is not in question.
The EPA came in after he built the pond and stated that they had the right to govern the creek next to it, therefore they had a right to shut down the pond. They gave him 30 days to remove the pond. (Which was stupid, because doing so could have led to an environmental disaster to the creek, something the EPA knows how to do well.)
Sp the farmer has done everything legally required of him. The EPA is stepping in where they have no legal right. And they are levying stupidly high fines without a law to back them up, and without due process.
The EPA will get smacked down again in court. Again.

Will the EPA fine themselves for the Animas River fiasco? The EPA needs to go and whichever candidate is ready to do it gets my vote.
