Funds would be appropriated to the University system. The University system would be responsiable for the cost of the football program since those cost would be maindated by state law.

Yeah, I guess that's my question. If the state says you must play football and like most schools, you've had to subsidize the athletic department, the state is saying go ahead and subsidize?

It would depend on the exact wording, but UAB would have to use some portion of its funding for football - it could be FCS (non-scholarship up to a full 63 scholarships) or FBS. The only catch is that UAB cannot count football towards Division I sports sponsorship requirements unless if it funds at least 31.5 scholarships (FCS), although it would only be relevant if UAB never fields a men's cross country or track team. If UAB returns to FBS I believe the minimum is around 76 scholarships, higher than the 50% requirement for other sports.
