What is Misdemeanor Assault?
Misdemeanor Assault, or “simple assault”, is basically an attempt to commit a battery. Monetary fines (anywhere from hundreds of dollars to $1,000) AND/OR
Jail sentence in a local county jail (not a federal prison facility)
Possible exposure to a civil lawsuit- the defendant would then be liable for the victim’s injuries or losses. Punitive damages may be awarded in some cases

Yes, I know it's technically assault sparky. My point is this stuff is never prosecuted because its utterly itrelevant and serves only to clutter an already overworked criminal justice system

Maia, assault is a criminal court issue. You can't file a civil suit because somebody committed a criminal act. You have to show damages from that act you're trying to recoup. There is no case here. No harm can be shown

Only in a criminal suit. The guy isn't getting arrested (that I can tell), so that only leaves a civil suit.

Smart is almost certainly done for the year. While I know people are going to say no excuse for what he did, fans can get completely out of control. The higher standard should go both ways. From the video, it looked like a very good chance that at least the ladies nearby were saying some disrespectful things and one was clapping in his face. This is a 19-20 year old guy doing this for free. The same day this happened, we have fans spitting on players:
