How did Liberty vote on the amendment to NCAA rules requiring a conference invitation to move between divisions or football subdivisions? If they helped approve the rule change, suing the NCAA wouldn't look good. Note that this same rule also helps protect Liberty from losing more big name opponents from FCS, and blocks a flood of Division II members from moving to Division I. In fact, the main reason this rule was adopted was to deter movements motivated by basketball tournament money, not football. Impeding FCS/FBS movements was an afterthought, proposed by the committee representing FCS interests no less.
Any NCAA member would look bad if they support the rules when they suit them but try to do away with them when they don't, whether it's Ohio State, Harvard or Liberty U. People seem to forget that the NCAA is ultimately a democratic entity in which each institution gets a vote, and not some dark, evil monolith that forces oppressive rules down its members' throats.
