Obama recess appointments to labor board are unconstitutional
WASHINGTON — President Barack Obama violated the Constitution when he bypassed the Senate to fill vacancies on a labor relations panel, a federal appeals court panel ruled Friday.

A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit said that Obama did not have the power to make three recess appointments last year to the National Labor Relations Board.

The so called Constitutional scholar wouldnt know the document if it landed on his head

Well Obama will appeal but I don't know what remedy there really is. With the new filibuster changes dems are pushing he can just push his people through the senate now..

When that changes parties next time I wonder how many dems will want to revisit the changes they are putting in.

I think it opens them up to a bunch of appeals. It has the potential to invalidate everything they did since they were appointed (there wasn't a quorum on the board unless they are counted). It also prevents them from proceeding until the spots are filled.

I've heard that the decision by Senator Harkin (Democrat of Iowa) to not run for re-election was based, in part, on his unhappiness about the fact that the filibuster-rule was Not changed to any meaningful degree.
