If it's not supposed to be a representation of the US flag, what would you say it is intended to represent?
Hint: This is where common sense is used if you have any.
The answer is there isn't anything else it can be meant to represent other then the US flag.

If copyright and patent laws were applied there wouldn't be a judge, jury, or panel anywhere that would say that it is meant to represent anything other than the US flag. It's sole purpose is to tie the Obama campaign to the USA using the implied image of the US flag.

In the eyes of the law, anything with the flag is not illegal (except maybe flying it upside down at sea when you're not in distress may be construed the same as calling 911 and leaving the operator on the line as everybody comes to your house), but both are violations of the flag code.
